Rättsområdet ”hyra av lös sak” är i stort sett oreglerat i Norden. Historiskt sett har denna kontraktsform sällan varit frekvent förekommande eller rört föremål av högt värde
Inom civilrättens område har de nordiska länderna mycket gemensamt. Mycket av detta har på ett ideologiskt plan sitt ursprung i skandinavismen som växte sig stark i mitten på 1800-talet. Genom denna kom länderna att utarbeta gemensamma lagar där den fortsatt gällande svenska avtalslagen har en dansk, norsk och finsk motsvarighet vilka fortfarande delar bety-dande likheter.

Inom civilrättens område har de nordiska länderna mycket gemensamt. Mycket av detta har på ett ideologiskt plan sitt ursprung i skandinavismen som växte sig stark i mitten på 1800-talet. Genom denna kom länderna att utarbeta gemensamma lagar där den fortsatt gällande svenska avtalslagen har en dansk, norsk och finsk motsvarighet vilka fortfarande delar bety-dande likheter.
Med detta historiska perspektiv framkommer ur komparationen att det-samma kan sägas om förevarande rättsområde. Hyra av lös sak är även i våra nordiska grannländer oreglerat och analogier till närliggande kodifi-kationer och relevanta rättsfall samt viktig doktrin görs för att avgöra rätts-liga tvister inom området. Några betydande skillnader kan inte redovisas.
Portugal är ett av de få länder som har en någorlunda heltäckande civil-rättslig reglering på området, med en särskild lag riktad mot leasing. Denna lag är i stort skriven för att skydda de som hyr ut egendom och in-nehåller tydliga bestämmelser gällande avtalstid, hur avtalet kan utformas, hyresmannens och uthyrarens skyldigheter och rättigheter m.m. En bety-dande skillnad är att hyresmannen, enligt den portugisiska lagen, har rätt att köpa egendomen efter hyrestidens slut. Detta skulle enligt svenska reg-ler räknas som ett kreditköp och därmed skulle lagen som helhet inte vara gällande på förevarande rättsområde. (Less)

The legal area of "hiring of personal property" is largely unregulated in the Nordic countries. Historically, this type of contract has rarely been of fre-quent use or valued concerns.
Within the field of civil law, the Nordic countries have much in common. Much of this has its ideological origins in Scandinavianism, which gained momentum in the mid-19th century. This movement led the countries to develop common laws, with the still-valid Swedish Contract Act (Avtalslagen) having Danish, Norwegian and Finnish counterparts that continue to share significant similarities.
From this historical perspective, comparison reveals that the same holds true for the legal area at hand. Hiring of personal property is also unregu-lated in our Nordic... (More)
The legal area of "hiring of personal property" is largely unregulated in the Nordic countries. Historically, this type of contract has rarely been of fre-quent use or valued concerns.
Within the field of civil law, the Nordic countries have much in common. Much of this has its ideological origins in Scandinavianism, which gained momentum in the mid-19th century. This movement led the countries to develop common laws, with the still-valid Swedish Contract Act (Avtalslagen) having Danish, Norwegian and Finnish counterparts that continue to share significant similarities.
From this historical perspective, comparison reveals that the same holds true for the legal area at hand. Hiring of personal property is also unregu-lated in our Nordic neighbouring countries. Analogies to related codifica-tions, relevant case law and important legal doctrine are used to resolve legal disputes within this area. No significant differences can be identified.
Portugal is one of the few countries with regulation in this area, having a specific law directed at leasing. Leasing itself is a type of long-term rental that falls within this legal area. This law is largely aimed at protecting les-sors and contains clear provisions regarding the contract period, how the contract can be structured, the lessee's and lessor's obligations and rights, etc. A significant difference is that the lessee, to Portuguese law, has the right to purchase the property at the end of the lease term. Under Swedish law, this would be considered a credit purchase, and therefore the Portu-guese law as a whole would not be directly applicable to the legal area at hand. (Less)
