- Denna uppsats syftar till att undersöka folkrättsbrottet folkmord i dess generella drag, för att ge ett helhetsperspektiv vad gäller de olika rekvisit, hur dessa bör tillämpas samt vilken effekt de haft i tidigare avgjorda eller pågående mål.
Folkmordsbrottet definieras främst utifrån de fem handlingar som uppställs i Art II a-e i Folkmordskonventionen. För att få en djupare förståelse kring definitionerna kommer William Schabas verk ”Genocide in International Law” vara grunden för att undersöka folkmordskonventionen.
Begreppet folkmord har blossat upp rejält efter konflikten mellan Israel och Hamas, varför det är av stort intresse att undersöka detta begrepp. Även om begreppet grundar sig i juridik, använts det mycket utanför juridiken... Uppsatsen tar främst sikte på att identifiera innebörden av begreppet folkmord, samt olikheterna vad gäller det juridiska resonemanget kring begreppet jämfört med hur en icke-juridisk person ser på det. Detta för att fastställa hur försiktig man ska vara med att anklaga någon för ett så allvarligt brott, som idag anses vara det största brottet som kunnat begås genom den mänskliga historian. The concept of genocide has gained significant attention following the conflict between Israel and Hamas, which makes it highly relevant to investigate the term. Although the concept is rooted in legal discourse, it is frequently used outside the legal context today, especially in relation to international conflicts – not least after Israel’s retaliation against Hamas follow the events of October 7, 2023.
The essay primarily aims to identify the meaning of the term genocide, as well as the differences in legal reasoning about the concept compared to how a non-legal person might perceive it. This is to determine how cautiously one should approach when accusing someone of such a serious crime, which today is considered to be the gravest form of offense that can be committed through human history.
