Abstract (Swedish)
I denna uppsats har jag undersökt konkurrensproblemet med delvis överlappande straffbud i straffrätten, bl.a. med hjälp av teorin om fair labelling. Först har rättskällornas lösningsförslag vad avser nämnda konkurrensproblem i allmänhet analyserats. Vidare har jag inriktat mig på den specifika relationen mellan brotten våldtäkt mot barn i 6 kap. 4 § brottsbalken (BrB) och utnyttjande av barn för sexuell posering, 6 kap. 8 § BrB. På grund av bestämmelsernas partiellt överlappande tillämpningsområden uppkommer frågan ifall åklagaren ska åtala respektive domstolen ska döma för båda brotten när de aktualiseras samtidigt, eller om brottet i 4 § ska konsumera det i 8 §. I denna uppsats har jag undersökt konkurrensproblemet med delvis överlappande straffbud i straffrätten, bl.a. med hjälp av teorin om fair labelling. Först har rättskällornas lösningsförslag vad avser nämnda konkurrensproblem i allmänhet analyserats. Vidare har jag inriktat mig på den specifika relationen mellan brotten våldtäkt mot barn i 6 kap. 4 § brottsbalken (BrB) och utnyttjande av barn för sexuell posering, 6 kap. 8 § BrB. På grund av bestämmelsernas partiellt överlappande tillämpningsområden uppkommer frågan ifall åklagaren ska åtala respektive domstolen ska döma för båda brotten när de aktualiseras samtidigt, eller om brottet i 4 § ska konsumera det i 8 §. Uppsatsen visar att konkurrenslösningen i allmänhet ska ta utgångspunkt i de allmänna konkurrensreglerna, vilka består i ett antal regler och principer om bl.a. brottens skyddsintressen och straffskalor. Vidare visar framställningen att frågan om domstolen ska döma både för brottet våldtäkt mot barn och brottet utnyttjande av barn för sexuell posering kan bedömas på olika sätt, och att domstolarna har ett relativt vidsträckt skönsmässigt utrymme vid avgörande av frågan. Jag visar emellertid att uttalandena i rättskällorna bör tolkas på så vis att konkurrenslösningen ska bestå i en dom i brottskonkurrens. Genom en analys utifrån teorin om fair labelling kommer jag slutligen fram till att den konkurrensrättsliga lösningen vad avser förhållandet mellan de specifika straffbuden bör vara en dom i brottskonkurrens, huvudsakligen på grund av straffbudens delvis olika skyddsintressen. I det fall gärningspersonens handlande uppfyller rekvisiten i såväl 6 kap. 4 § som 8 § BrB krävs att domstolen dömer för båda brotten för att gärningarna ska kunna anses ha betecknats på ett rättvist sätt utifrån teorin om fair labelling. Abstract
In this thesis, I have studied the problem of offence concurrence when several offences partially overlap in terms of area of application, among other things using the theory of fair labelling. Firstly, the proposed solutions regarding this general problem –presented in the sources of law – have been analysed. Furthermore, I have focused on the specific relationship between the crimes of rape against children in Chapter 6, Section 4 of the Swedish Penal Code and exploitation of children for sexual posing in Chapter 6, Section 8 of the Swedish Penal Code. In this thesis, I have studied the problem of offence concurrence when several offences partially overlap in terms of area of application, among other things using the theory of fair labelling. Firstly, the proposed solutions regarding this general problem –presented in the sources of law – have been analysed. Furthermore, I have focused on the specific relationship between the crimes of rape against children in Chapter 6, Section 4 of the Swedish Penal Code and exploitation of children for sexual posing in Chapter 6, Section 8 of the Swedish Penal Code. Due to the partially overlapping areas of application of the provisions, the question arises whether the prosecutor should prosecute and the court should sentence for both crimes when they occur simultaneously, or whether the crime in Section 4 should consume that in Section 8. The paper shows that the solution of the general problem of offence concurrence should be based on the general rules which regulates concurrence, which – among other – consist of rules and principles regarding the protected interests and scales of penalties of the offences. Moreover, the study shows that the question of whether the court should convict both for the crime of rape of a child and the crime of exploitation of a child for sexual posing can be assessed in different ways, and that the court have a relatively wide discretion when deciding the issue. However, I show that the statements in the legal sources should be interpreted to mean that the solution of this specific problem of offence concurrence should involve the court convicting the offender of both offences. Through an analysis based on the theory of fair labelling, I finally conclude that the solution of the specific problem of concurrence regarding the relationship between the mentioned crimes should be a conviction of both offences, mainly due to the partly different protected interests of the offences. I reach the conclusion that if the perpetrator’s actions meet the requirements of both Section 4 and 8 in Chapter 6 of the Swedish Penal Code, convicting the perpetrator of both offences is required for the acts to be considered to have been labeled in a fair manner according to the theory of fair labelling.
