Abstract
Chief executives and other persons in management positions are not applicable to the same protection system as other employees. Lagen om anställlningsskydd is not applicable for example. Instead all terms and conditions are in the employment contract, which get increased importance. The employment contract for a chief executive is comprehensive. This essay focuses on employment protection, wages and compensation, loyalty during the employment, secrecy and competitive clauses. It is not possible to stipulate a legally binding employment contract in which Lagen om anställningsskydd is not included. Chief executives and other persons in management positions are not applicable to the same protection system as other employees. Lagen om anställlningsskydd is not applicable for example. Instead all terms and conditions are in the employment contract, which get increased importance. The employment contract for a chief executive is comprehensive. This essay focuses on employment protection, wages and compensation, loyalty during the employment, secrecy and competitive clauses. It is not possible to stipulate a legally binding employment contract in which Lagen om anställningsskydd is not included. The final decision concerning if LAS should be taken into the agreement is taken by court, in regards to terms and conditions as well as work tasks. When chief executive employment is interrupted one differentiates notice of termination and revoking. An essential part in the chief executive employment agreement is the compensation, which can be brought out in several ways. The severance pay is supposed to give the chief executive an extended protection in case of termination of agreement from the employer. The obligation of loyalty during employment is not questioned in practice. There are no specials laws concerning secrecy and no decisions on secrecy can be found. The art of competitive clauses in Sweden is built upon the 1969 understandings between SAF and SIF/SALF/CF. There is a balance between the employer’s safety and the employee’s ability to use his qualifications. Most of the disputes concerning competitive clauses are decided by a court of arbitration.
