Utredning i barnets bästa? En rättssäkerhetsstudie av utredningar av familjehem

Detta arbete behandlar medgivandeutredningen (senare benämnd utredningen) av familjehem ur ett rättssäkerhetsperspektiv. Utredningar av familjehem görs utifrån bestämmelser i Socialtjänstlagen (SoL) och det är denna lag som utgör grunden för utredningarna. I arbetet görs därför först en beskrivning och kort genomgång av vad som historiskt föregått den lagstiftning som resulterat i SoL och den ramlagkonstruktion som idag präglar svensk rätt inom området. Därefter kommer en kort genomgång av de lagar som beslut om placering i familjehem vilar på, SoL och lagen om vård av unga (LVU), samt definitionen av vad ett familjehem är. Utredningar av familjehem görs utifrån bestämmelser i Socialtjänstlagen (SoL) och det är denna lag som utgör grunden för utredningarna. I arbetet görs därför först en beskrivning och kort genomgång av vad som historiskt föregått den lagstiftning som resulterat i SoL och den ramlagkonstruktion som idag präglar svensk rätt inom området. Därefter kommer en kort genomgång av de lagar som beslut om placering i familjehem vilar på, SoL och lagen om vård av unga (LVU), samt definitionen av vad ett familjehem är. Detta för att senare behandla de två utredningarna som görs. Tonvikten ligger här på utredningen av familjehemmet, och en genomgång av utredningen som sådan samt vilka metoder som används vid denna. Bestämmelserna som rör internationell adoption behandlas därefter, framför allt med fokus på utredningen av hemmet, och då i synnerhet utredningsområdena. En genomgång av begreppet barnets bästa görs i arbetet, samt en genomgång av begreppet rättsäkerhet. Detta för att senare i analysen utreda frågan utefter dessa två begrepp. I analysen jämförs senare utredningen av familjehem med utredningen av hem vid internationell adoption, och begreppet barnets bästa och rättssäkerheten i utredningarna utgör här ramen för den analysen.

Utredning av familjehem tillhör en av socialtjänstens viktigaste uppgifter. Ett beslut om placering utgör ofta en stor förändring av det enskilda barnets liv, och samhället tar i samma stund som placeringen verkställs på sig ansvaret för att barnet får växa upp under goda och trygga förhållanden. Familjehemmet är det som rent praktiskt sörjer för barnets omvårdnad under placeringstiden. En enhetlig metod eller krav på utredningen av familjehem existerar dock inte, och resultatet blir att utredningarna av familjehemmen ser olika ut i landets kommuner. Vilka områden som skall utredas i fall vid internationell adoption finns uppställt i lag, och är vidare utvecklat i både rättsligt material samt i material som socialtjänsten arbetar efter. Även om situationen mellan utredningen av familjehem och utredningen av hem vid internationell adoption skiljer sig åt på vissa punkter, finns det även vissa väsentliga likheter. Därför kan även en jämförelse dem emellan göras.

En jämförelse av utredningarna i de båda fallen samt regleringarna kring dessa görs i analysen. Fokus ligger här vid rättssäkerheten och tillgodoseendet av barnets bästa i frågan, för att kunna belysa bristerna vid utredningarna av familjehem. I analysen konstateras bland annat att lagstiftningen idag ger vida ramar för kommunerna och socialtjänstens arbete. En mer detaljerad lagstiftning kring frågan är svår att genomföra då den enskildes situation kan skilja sig åt markant från fall till fall. Dock behöver lagen och dess krav i utredningsfrågan ses över vilket också är något som tagits upp i en statlig utredning (SOU 2009:68), och frågan är idag högst aktuell. (Less)

This essay deals with the investigation of the foster home and the requirements that the Social Services Act (hereafter referred to as SoL) holds for this. The issue is dealt with in the perspective of the rule of law of the requirements in the investigation, and the best interest of the child.

The first part deals with the historical background for the modern SoL and the process that has led to this law that today reflects the regulations of investigations of the foster home. This essay deals with the investigation of the foster home and the requirements that the Social Services Act (hereafter referred to as SoL) holds for this. The issue is dealt with in the perspective of the rule of law of the requirements in the investigation, and the best interest of the child.

The first part deals with the historical background for the modern SoL and the process that has led to this law that today reflects the regulations of investigations of the foster home. The second part deals with the legal regulations of investigations of both the situation of the child, and of the foster home. The focus in the essay lies in the investigation of the home and the requirements in the SoL, and the methods the social services uses. Thereafter a short review of the regulation of investigation of homes in case of international adoption is done, and the major parts concern the requirements that the SoL holds in that investigation. The following analysis is done with consideration of the best interest of the child and the rule of law in the requirements that the SoL holds, and a comparison between the requirements in both investigations is completed.

Good foster care is one of the social services most important issues. A decision about placing a child in foster home is a very major intrusion in the child’s life. Society takes the responsibility of the child’s welfare, and it is the foster home that practices this care. However, the requirement of the investigations of the foster homes differentiates in the counties, and there is no resemblance of the methods that social services are using in different parts of the country. The social service has in case of an international adoption some specific circumstances that they have to address to in the investigation of the home, according to the SoL. The situation between foster care and international adoption differentiates in certain considerations. But there is also some similarities to the situations and therefore a comparison can be done.

In the analysis a comparison between both investigations is done, with focus on both the best interest of the child, and the rule of law in the requirements that the investigation holds in both cases. A clarification of the rule of law and the best interest of the child in the investigation of the foster home are also done. Furthermore establishes that the legislation of this area today gives a very wide frame in the interpretation of the law. A more detailed regulation would probably be very difficult, as the situation for the individual child differentiates from case to case. However, a review of the legislation regarding the investigation needs to be considered, which currently took place in the Official Reports of the Swedish Government, SOU 2009:68, and the question is a very current one today.
