Inhyrning av personal är ett relativt nytt inslag på den svenska arbetsmarknaden och är ett resultat av att bemanningssektorn avreglerades i början på 1990-talet. Hösten 2009 valde företaget Urban Outfitters att tillgodose butikens permanenta personalbehov med inhyrda konsulter som var förre detta anställda för att inte behöva teckna ett kollektivavtal. Urban Outfitters blev en symbol för ansvarslösa arbetsgivare som inte ville foga sig efter den svenska modellen. Inhyrning av personal är ett relativt nytt inslag på den svenska arbetsmarknaden och är ett resultat av att bemanningssektorn avreglerades i början på 1990-talet. Hösten 2009 valde företaget Urban Outfitters att tillgodose butikens permanenta personalbehov med inhyrda konsulter som var förre detta anställda för att inte behöva teckna ett kollektivavtal. Urban Outfitters blev en symbol för ansvarslösa arbetsgivare som inte ville foga sig efter den svenska modellen. Uppsatsens syfte är att undersöka begreppet inhyrning (permanent och temporär) i relation till rättskällor, kollektivavtal och personaluthyrnings aktörer samt att undersöka om företag utan anställda är ett nytt och växande fenomen. Det finns ingenting i rättskällorna som förbjuder inhyrning, däremot arbetade fackföreningarna aktivt i 2010 års avtalsrörelse för att införa begränsningar mot inhyrning i kollektivavtalen. Personaluthyrningens aktörer upplever att inhyrning skapar flexibilitet på arbetsmarknaden, samtidigt som de inhyrda konsulterna har ett svagt anställningsskydd. Slutligen kan det konstateras att temporär inhyrning men största sannolikhet kommer att bestå på den svenska arbetsmarknaden, men att permanent inhyrning inte är en framtida trend då det finns många fördelar för arbetsgivare med att ha personal i egen regi. Hiring of staff through staffing agencies is a relatively new phenomenon on the Swedish labor market, and it is a result of the deregulation of the staffing sector in the beginning of the 1990s. In the fall of 2009 the company Urban Outfitters decided to meet their staffing demands by using a staffing agency to avoid having to form a collective agreement. Urban Outfitters became a symbol for irresponsible employers who did not want conform to the Swedish model. Hiring of staff through staffing agencies is a relatively new phenomenon on the Swedish labor market, and it is a result of the deregulation of the staffing sector in the beginning of the 1990s. In the fall of 2009 the company Urban Outfitters decided to meet their staffing demands by using a staffing agency to avoid having to form a collective agreement. Urban Outfitters became a symbol for irresponsible employers who did not want conform to the Swedish model. This essay’s aim is to analyze the concept of hired staff (staff hired through staffing agencies) in relation to traditional sources of law, collective agreements and the participants such hiring and to examine whether companies without employees is a new and growing phenomena. There is nothing in the traditional sources of law that prohibits hiring of staff through staffing agencies, however, the Swedish trade unions worked actively in the wage negotiations of 2010 to restrict the possibilities to use hired staff in the collective agreements. Staffing agencies create flexibility on the labor market, but their consultants have poor job security. The conclusion is that there is a high probability that using hired staff temporarily will remain on the Swedish labor market, while using hired staff permanently isn’t a future trend since having their own employees provides many advantages for employers.
