Abstract
The purpose of this paper is to analyze if the multiculturalism expressed in the personal laws has had a negative impact on the rights of Muslim and Hindu women and in that case, how. This paper also aims to analyze why there is a tension between minorities cultural rights and women’s individual rights in India. This is done trough a examination of various sections in the “Hindu Marriage Act” from 1955, the “Hindu Succession Act” from 1956, the “Dissolution of Muslim Marriage Act” from 1939 and the “Muslim Women’s (Protection of rights on divorce) Act” from 1986. The purpose of this paper is to analyze if the multiculturalism expressed in the personal laws has had a negative impact on the rights of Muslim and Hindu women and in that case, how. This paper also aims to analyze why there is a tension between minorities cultural rights and women’s individual rights in India. This is done trough a examination of various sections in the “Hindu Marriage Act” from 1955, the “Hindu Succession Act” from 1956, the “Dissolution of Muslim Marriage Act” from 1939 and the “Muslim Women’s (Protection of rights on divorce) Act” from 1986. But also by a description of what culture and multiculturalism is. A study on how multiculturalism and human rights are connected has also been made. My conclusion is that the “Hindu Marriage Act” not necessarily means that multiculturalism has had a negative impact on the Hindi women’s rights. But in the other laws there are some sections that discriminate women. The tension between cultural rights and women’s rights in India has its origins in the promises that were given to minorities in the Constitution, the personal laws and the old conflicts between Muslims and Hindus. This is also connected to the right to a culture and the right to equality in different international documents. (Less)
