- En medborgare är gentemot det allmänna skyddad mot frihetsberövande enligt svensk grundlag. Det finns dock undantag från denna grundlagsskyddade rättighet om begränsningen sker genom lag och tillgodoser ändamål som är godtagbara i ett demokratiskt samhälle. Det får aldrig gå utöver vad som är nödvändigt med hänsyn till det ändamål som har föranlett begränsningen.
Något som är reglerat i lag och som anses vara godtagbart i ett demokratiskt samhälle kan vara att frihetsberöva en person som är misstänkt för ett brott. Detta kallas häktning och i vissa situationer kan man kombinera häktning med restriktioner.

Europarådets tortyrkommitté har kritiserat Sverige de senaste 20 åren på grund av att Sverige använder sig av häktning och restriktioner alldeles för frekvent. Något som även uppmärksammades var att det finns indikationer som visar på geografiska skillnader i Sverige vid användande av restriktioner.
Under år 2010 fick Utvecklingscentrum i Malmö i uppdrag av den svenska regeringen att utreda om denna kritik är befogad och om det finns geografiska skillnader i Sverige samt vad som i så fall orsakar dem.
I denna utredning fokuserar jag på de geografiska skillnaderna och jag lyckades konstatera att det finns geografiska skillnader vid användande av restriktioner. De största geografiska skillnaderna konstaterades mellan Uppsala, Karlskrona och Karlstad som använder restriktioner mer frekvent än City, Nyköping och Eskilstuna. I Uppsala finns det exempelvis 28 % fler antal häktade med restriktioner än vad det finns i Nyköping.
Min utredning fortsatte genom att studera orsakerna till de geografiska skillnaderna. De faktorer som påverkade den geografiska skillnaden var framförallt brottstyper, ålder på de häktade, geografiska placeringen samt kulturella skillnader. När man beaktade dessa faktorer som orsakar de geografiska skillnaderna drogs slutsatsen att det inte längre existerar några påtagliga geografiska skillnader.
De geografiska skillnaderna som finns i Sverige kan alltså till stor del förklaras och eventuell kritik mot Sverige bör anses obefogad i denna del (Less) - Abstract

In this study I managed to find that there are geographical differences in the use of restrictions.
The largest differences were found between Uppsala, Karlstad, Karlskrona which uses restrictions more frequently than in City, Nyköping and Eskilstuna. In Uppsala there are for example 28 % more number of detainees with restrictions than there are in Nyköping.
My study continued by studying the causes of the geographical differences. The factors that influenced the difference was above all types of crime, age of the arrested, geographical location and cultural differences.
When considering these factors that cause the geographical differences, it was concluded that it no longer exists any substantial geographical differences. (Less)
