Abstract
Migration has been around from time immemorial because of the possibilities of better life conditions. Undocumented migrants are a particular vulnerable group in the labour market in Sweden as well in Europe. They can mainly be found in low skilled jobs in the informal economy. They work long hours under minimum wage in construction, cleaning and catering. This has complicated the trade unions main task; to supervise the adherence of the collective agreements. Undocumented migrants are a particular vulnerable group in the labour market in Sweden as well in Europe. They can mainly be found in low skilled jobs in the informal economy. They work long hours under minimum wage in construction, cleaning and catering. This has complicated the trade unions main task; to supervise the adherence of the collective agreements. The purpose of this study is to examine how the Swedish state and the labour market parties stand in relation to undocumented migrants and their rights in the working life. The conclusions are that undocumented migrants have actual rights in their working situation; despite their position in migration law. However, they lack access to their rights. In addition, there isn´t any coercive implementation mechanisms to enforce Sweden’s international commitments. The trade unions such as LO, TCO and Syndikalisterna, while agreeing on some aspects of undocumented migrants rights, don´t share a common perspective on the main question: their right to association.
