- Uppsatsen behandlar utbildning och kompetensutveckling på arbetsplatser i Sverige utifrån ett arbetsrättsligt perspektiv. Varken arbetsgivares eller arbetstagares utbildningsansvar är i vidare utsträckning lagreglerat. Rättspraxis visar dock att både arbetsgivare och arbetstagare har ett visst ansvar för kompetensutvecklingen på arbetsplatser. Huvudansvaret får anses ligga på arbetsgivare. Arbetsgivare har framförallt ett ansvar vid arbetsbristuppsägningar då arbetstagaren gör anspråk på att han eller hon har tillräckliga kvalifikationer för andra arbetsuppgifter hos arbetsgivaren. Kompetensutveckling är ett ständigt aktuellt ämne och sedan några år tillbaka har kunskapssamhällets ökade krav på kompetensutveckling diskuterats. Vikten av kompetensutveckling för att stärka arbetstagares ställning på arbetsmarknaden är svårt att nog betona. I uppsatsen görs därför ett försök till att föreslå hur arbetstagares anställningsskydd vid arbetsbristuppsägningar på grund av bristande kompetens kan stärkas och hur kompetensutvecklingsansvaret tydligare kan regleras. The responsibility to educate is basically unregulated; yet case law states that both employers and employees are held responsible to some degree, with the main burden of responsibility on the employer. The employers’ responsibility during a redundancy dismissal is apparent when an employee gives reason to show that he or she has sufficient qualifications for other tasks within the company. The employers’ responsibility during a redundancy dismissal is apparent when an employee gives reason to show that he or she has sufficient qualifications for other tasks within the company. Furthermore, the employer has a responsibility to educate previous trade-union representatives. Responsibility to educate can also be reinforced with a competence development agreement. This kind of agreement, in combination with case law states the contents of the education, the time span, and the burden of responsibility on the employee.
Competence development is a current topic and has been looking a few years back with social development towards a knowledge society. With this, competence development is becoming crucial for employees to stay attractive on the labour market. Knowing this, I have tried to explain how employment protection can be strengthened during a redundancy dismissal. I also tried to describe how regulations could help to clarify where the burden of responsibility lies, thus strengthening the employees’ protection. (Less)
