Abstract (Swedish)
I augusti i år trädde ändringar av arbetstidslagen (1982:673) i kraft. Ändringarna innebar att det dispenskrav som Arbetsmiljöverket tidigare har haft, som gav dem befogenheten att bevilja uttag av extra övertid, extra mertid och nödfallsövertid som överskrev två dygn, togs bort. Arbetsgivarna har nu i stället möjlighet att själva avgöra om situationen är av sådan karaktär att den kräver att denna extra övertid, mertid eller nödfallsövertid får tas ut. För att arbetsgivarna inte ska komma att missbruka denna möjlighet, har skyddsombuden blivit tilldelade en möjlighet att utföra tillsyn och göra framställningar om de upplever att bestämmelserna i lagen inte efterlevs.

Abstract
The 1st of August 2011 the Swedish government adopted some changes in the Act regulating the working time. Before the 1st of August the employers had to get a exemption if they needed to take out overtime for an employee expanding the 200 hours limitation of overtime. The exemption was given by the authority controlling the work environment. After the change the exemption was removed and the employers themselves were given the right to decide whether to make an employee work this extra overtime or not. A representative of the employees will instead of the authority do the supervision and also possesses the right to make requests to ensure the regulations are followed.

The purpose of this essay is to distinguish how the changes will affect the Swedish principle of law called Arbetsledningsrätten, the employer’s right to direct and control the work performed by his employees. Will the changes have a positive or negative impact on the principle? Will the impact on the principle, in its turn, affect the amount of overtime the employers take out? (Less)
