Konkurrensrätten är ett fundament inom EU- rätten och ett medel för att värna om den fria handeln på den inre marknaden.

Det i sin tur står i kontrast till nationella intressen som under lång tid genomsyrat flygindustrin i Europa som kännetecknats av statligt ägande.

I ljuset av de traditionellt statliga ingripandena i flygsektorn har EU:s statsstödsregler en väsentlig betydelse. Effektiv tillämpning av konkurrensreglerna är av stor vikt för att förhindra en snedvridning av unionens flygmarknad.

Uppsatsen behandlar Europeiska Unionens regelverk avseende statligt stöd till flygbolag som är helt eller delvis ägda av staten där statsstödrätten sätts i ett rättspolitiskt, rättsekonomiskt och i ett historiskt sammanhang.

Competition law is the foundation of EU law as much as it is a means to protect free trade on the internal market.

This in turn stands in contrast to national interests that have long pervaded within the aviation industry in Europe that has been characterized by State ownership.

In light of traditional government intervention in the aviation sector, the EU State aid law has a significant impact. Effective application of competition rules is of outmost importance in preventing distortion of the EU aviation market.

This paper considers European Union rules on state aid to airlines that are entirely or partially owned by the State where State aid law is put into a political, economical and historical context.
