Both legal and social resources at the EU’s disposals for influencing the progress of the development of the right are reviewed. However, the lacking foundation of common ideas, interests and identities points to fundamental problems which restrain the implementation and successful protection of minorities within the EU. The analysis highlights the merit of using the social constructivist criteria of a forum for deliberation and persuasion to achieve the norms set out by the EU. (Less)
