Abstract
The aim of this study is to examine and further the understanding of the relationship between the EU and the rights of minorities. It will address how structures affect the development of rights in the member states and how member states in turn affect the structures. Through a descriptive qualitative literature study the objective structural conditions at play for development of minority rights are analyzed within a social constructivist conception, to shed light on the possibilities and limitations held by the agents at play.

The aim of this study is to examine and further the understanding of the relationship between the EU and the rights of minorities. Both legal and social resources at the EU’s disposals for influencing the progress of the development of the right are reviewed. However, the lacking foundation of common ideas, interests and identities points to fundamental problems which restrain the implementation and successful protection of minorities within the EU. The analysis highlights the merit of using the social constructivist criteria of a forum for deliberation and persuasion to achieve the norms set out by the EU. (Less)
