Våldtäkt eller olaga tvång? - En analys av begreppet sexuell handling i svensk sexualstraffrätt

Denna uppsats tar avstamp i mål B 1883-12 och B 1195/13 gällande så kallade otrohetskontroller. Hovrätten lade i båda fallen fokus på begreppet sexuell handling och har använts sig av prop. 2004/05:45 - En ny sexualbrottslagstiftning som utgångspunkt för att avgöra om handlingarna bör definieras såsom sexuella eller ej. Således avgjordes huruvida handlingarna föll inom området för sexualbrott, mer precist under bestämmelserna för de yrkade brotten våldtäkt respektive sexuellt tvång. I denna uppsats undersöks närmare begreppet sexuell handling och den betydelse det fått inom straffrätten. Denna uppsats tar avstamp i mål B 1883-12 och B 1195/13 gällande så kallade otrohetskontroller. Hovrätten lade i båda fallen fokus på begreppet sexuell handling och har använts sig av prop. 2004/05:45 - En ny sexualbrottslagstiftning som utgångspunkt för att avgöra om handlingarna bör definieras såsom sexuella eller ej. Således avgjordes huruvida handlingarna föll inom området för sexualbrott, mer precist under bestämmelserna för de yrkade brotten våldtäkt respektive sexuellt tvång. I denna uppsats undersöks närmare begreppet sexuell handling och den betydelse det fått inom straffrätten. En studie av hur hovrätterna har resonerat i ovan nämnda fall görs, förarbeten gällande främst den nya sexualbrottslagstiftningen från 2005 undersöks, äldre praxis behandlas och doktrin på området lyfts. Allt i syfte att försöka kasta ljus över begreppets definition och uppmärksamma den problematik som olika tolkningar av begreppet för med sig.
I förarbetena till den nya sexualstrafflagen lyfts individens sexuella integritet fram som ett viktigt skyddssyfte med ändringarna. Propositionen berör vidare hur en sexuell handlings karaktär såsom just sexuell bör fastställas; på objektiva grunder. Propositionen markerar dock även hur gärningsmannens syfte med en viss handling kan få genomslag om särskilda omständigheter är för handen. För att sätta gällande rätts syn på en sexuell handling i en samhällelig kontext undersöks doktrin som behandlar sexualitetens olika uttryckssätt och undersöker dess beståndsdelar ur ett feministiskt perspektiv. Problematiken som därmed blir synlig är den diskrepans som föreligger mellan syftet med lagen och dess tillämpning i praktiken samt hur gällande rätt definierar begreppet sexuell handling med utgångspunkt i den erotiska, lustfyllda sexualiteten och därmed diskvalificerar sexuella handlingar som utförs främst i syfte att demonstrera makt och dominans över offret. Abstract
This essay takes its starting point in cases B 1883-12 and B 1195/13 concerning actions made by men in order to control suspected infidelity in their respective girlfriends. In the legal process The Swedish Court of Appeal, Hovrätten, put their main focus on the term sexual action. Further the court in both cases used the legislative proposal, prop. 2004/05:45 - En ny sexualbrottslagstiftning, leading up to the new regulation concerning sexual offenses adopted in the year of 2005, as a base to decide whether the actions should be defined as sexual or not. By doing so, the court could also decide whether the actions belonged within the area of sexual offence or to be more precise, within the provisions for the claimed offences rape and... (More)
This essay takes its starting point in cases B 1883-12 and B 1195/13 concerning actions made by men in order to control suspected infidelity in their respective girlfriends. In the legal process The Swedish Court of Appeal, Hovrätten, put their main focus on the term sexual action. Further the court in both cases used the legislative proposal, prop. 2004/05:45 - En ny sexualbrottslagstiftning, leading up to the new regulation concerning sexual offenses adopted in the year of 2005, as a base to decide whether the actions should be defined as sexual or not. By doing so, the court could also decide whether the actions belonged within the area of sexual offence or to be more precise, within the provisions for the claimed offences rape and sexual coercion. In this essay the term sexual action and the meaning it has been given on the field of criminal law is examined closer. A study of the arguments used by the Court of Appeal in the cases mentioned above is made, the preparatory work regarding foremost the new law from 2005 is investigated, older case law is processed an doctrine on the legal area is raised. This is done with the purpose of trying to highlight the definition of the term sexual action and notice the complex of problems that comes with the different interpretations.
In the preparatory work leading up to the law of 2005 the individuals sexual integrity is emphasized as one of the most important subjects that the new regulations are set out to protect. The legislative proposal further explains how an action is categorized as sexual or not based on its conceivably sexual character, and explains that this character is determined on objective grounds. The proposal also mentions how the intentions of the offender concerning a specific action, are given meaning if particular circumstances are established. To put the legal definition of the sexual action in a context, doctrine that is examining the different expressions of sexuality and its fragments from a feminist perspective is presented. What is thereby discovered is the discrepancies between the purpose of the law and the application of the law in practice. More, the legal definition is based on the erotic, joyful sexuality and consequently discriminates sexual acts that are foremost made to demonstrate power and dominance over the victim. (Less)
