Bestraffningsideologiernas inverkan på det svenska straffsystemet

Denna uppsats behandlar bestraffningsideologiernas innebörd, historia och deras påverkan på det svenska straffsystemet. Uppsatsen försöker besvara vilka syften de olika ideologierna är tänkta att fylla och hur de vuxit fram.

Syftet är att undersöka hur olika bestraffningsideologier har präglat det svenska påföljdssystemet, både förr och nu. Vidare behandlas frågan om hur systemet kan komma att se ut i framtiden.

Uppsatsen inleds med en kort genomgång av individualprevention, allmänprevention och proportionalitet. Individualprevention syftar främst till att uppnå laglydighet genom att på olika sätt påverka brottslingen. Denna uppsats behandlar bestraffningsideologiernas innebörd, historia och deras påverkan på det svenska straffsystemet. Uppsatsen försöker besvara vilka syften de olika ideologierna är tänkta att fylla och hur de vuxit fram.

Syftet är att undersöka hur olika bestraffningsideologier har präglat det svenska påföljdssystemet, både förr och nu. Vidare behandlas frågan om hur systemet kan komma att se ut i framtiden.

Uppsatsen inleds med en kort genomgång av individualprevention, allmänprevention och proportionalitet. Individualprevention syftar främst till att uppnå laglydighet genom att på olika sätt påverka brottslingen. Allmänpreventionens mål är att uppnå laglydighet genom att avskräcka andra än brottslingen från att begå brott. Proportionalitetsprincipen, i detta sammanhang, syftar till att uppnå rättvisa genom att straffet står i proportion till brottet. Rättvisa straff och tydliga straff ska sedan leda till både individuell och allmän prevention.

Vidare ges i uppsatsen en historisk tillbakablick där det konstateras att straffen gått från en rent vedergällande funktion till ett system som präglats av alla de ovan nämnda ideologierna.

I uppsatsens sista del behandlas kritiken mot gällande rätt. I analysen värderas denna kritik av författaren. (Less)

This essay deals with the meaning of different punishment ideologies, their history and their impact on the Swedish penal system. The essay tries to answer which purposes the different ideologies are supposed to fill and how they have evolved.

This essay deals with the meaning of different punishment ideologies, their history and their impact on the Swedish penal system. The essay tries to answer which purposes the different ideologies are supposed to fill and how they have evolved.

The aim is to investigate how different punishment ideologies have shaped the Swedish penal system, both in the past and in the present. Furthermore, the aim is to adress the question of how the system might look in the future.

The essay begins with a brief review of individual prevention, general prevention and proportionality. Individual prevention is mainly aimed to achieve compliance with the law through affect on the criminal in various ways. The goal of general prevention is to achieve compliance with the law by deterring other than the offender from committing crimes. The principle of proportionality, in this context, is to achieve justice by a punishment proportionate to the crime. Fair and clear penalties should then lead to both individual and general prevention.

Furthermore a historical perspective is given in the essay, which states that punishment has gone from a purely retributive function to a system that is characterized by all of the above mentioned ideologies.

The last part of the essay treats the criticism of the current law. In the analysis this criticism is evaluated by the author. (Less)
