Abstract
This essay highlights a discussion that arose in connection with the ‘Pirate Bay’ case, concerning impartiality of judges. The purpose of the essay is to investigate the circumstances under which a judge may have a conflict of interest, and how this issue should be solved when the solution is unclear. The essay focuses on the rule in Chapter 4, Section 14, note 10, and how it was applied in the present case. To investigate the legal question, I used literature, court cases and Internet-based sources. The aim was to analyze the conflict of interest issue from a critical perspective.

This essay highlights a discussion that arose in connection with the ‘Pirate Bay’ case, concerning impartiality of judges. The purpose of the essay is to investigate the circumstances under which a judge may have a conflict of interest, and how this issue should be solved when the solution is unclear. The essay focuses on the rule in Chapter 4, Section 14, note 10, and how it was applied in the present case. To investigate the legal question, I used literature, court cases and Internet-based sources. The aim was to analyze the conflict of interest issue from a critical perspective.

The court rejected all objections to the impartiality of the judges. The court had to consider the various factors that may have resulted in grounds for a conflict of interest. This essay divides the factors into three separate areas, each of which are individually analyzed. The first and most central issue was whether the judge’s involvement in an association could have led to doubts about his impartiality. The interests of the association were in line with what was to be decided in the main case.

The court had to decide when such an involvement could comprise grounds for a conflict of interest. The court determined that the interests of the associations were of a general nature, which is also in line with that laid down in the Swedish Constitution. These grounds were not of such a type that would disqualify a judge from presiding over a case.

The other question was whether a judge’s connection to a party could raise questions about his impartiality to handle the case. The lawyers of one party were members of the same association as the main judge. The question was whether this connection was to be considered grounds to disqualify a judge. The association was large and open, which led to the conclusion that this connection was not grounds for a conflict of interest.

The essay investigates the grounds under which a judge related to a party could be subject to disqualification. Practice and doctrine have set a relatively high requirement for when such a relationship means disqualification for a judge.
However, a decision should always take into account all the circumstances of each case, which may lead to different outcomes in different cases.
The essay further illustrates when a judge is to be disqualified after previously appearing in legislative work. This part has not been considered in as much detail in the essay. This subject has not been discussed in the same way as the above situations, and so is not covered to the same depth in the essay. However, in several cases, the European court has decided that circumstances like this could comprise grounds for disqualification.

Finally, the essay discusses whether the grounds for disqualification are adequate in their present form. The provision is sometimes difficult to interpret and has led to indistinct and contradictory results. The question can be raised about whether there should be guidelines for how these policies should be interpreted. The essay considers the fact that the rule, in rare cases, may lead to unreasonable economic consequences. If grounds for disqualification are detected after a ruling has been declared, there are no other options than to nullify the first ruling and then start the whole case again from the beginning.

Denna uppsats belyser den jävsdiskussion som aktualiserades i samband med ”The Pirate Bay-målet”. Uppsatsens syfte är att utreda vilka omständigheter som kan utgöra jäv för en domare och hur rätten ska resonera där jävsfrågans lösning är oklar. Uppsatsen fokuserar på den så kallade generalklausulen i 4 kap 13 § 10 p RB och hur denna tillämpades i rättsfallet. För att utreda rättsfrågan använder jag mig av litteratur, praxis och internetbaserade källor. Detta för att analysera jävsfrågan i ett kritiskt perspektiv där omständigeter som ansetts innebära jäv presenteras.

I två olika beslut avslogs de åberopade jävsinvändningarna avseende en domare som medverkat tingsrätten och två domare som dömt i hovrätten. Rätten hade i fallet att ta ställning till olika omständigheter som påstods grunda jäv. Uppsatsen delar upp dessa i tre områden som kommenteras separat.

Den första och mest centrala frågeställningen var om domarnas föreningsengagemang kunde medföra tvivel angående deras opartiskhet att döma i ett mål med anknytning till sådana föreningars intressen. Föreningarnas intresse av ett ökat upphovsrättsskydd låg i fallet i linje med målsägandesidans intresse.

Rätten hade att ta ställning till hur starkt intresse föreningarna hade av målets utgång och om detta kunde göra domarna jäviga. Rätten kom fram till att föreningarnas intresse var av allmän art vilket även låg i linje med det som stadgas i svensk grundlag. Detta kunde inte anses vara ett sådant direkt intresse som generellt sätt gör en domare jävig.

Den andra frågan var när jäv kan anses föreligga då en domare har en viss koppling till en part. Målsägandesidans ombud satt i fallet med i samma föreningar som domarna, vilket lyfte frågan om detta kunde anses vara ett sådant jävssamband enligt 4 kap 13 § 10. RB? Då det rörde sig om öppna stora föreningar som endast främjade en debatt i frågan ansågs detta av rätten inte utgöra ett sådant samband som ensamt gjorde domarna jäviga. En koppling till en part måste således vara starkare än så för att grunda jäv. Uppsatsen utreder vad som krävs för att en domares samband till en part ska anses utgöra en jävsgrund. Praxis och doktrin har fastställt ett förhållandevis högt krav på när ett sådant samband ska grunda jäv. Det krävs i regel en uppenbar ovänskap eller ett nära vänskapsförhållande för att en domare ska anses jävig att döma i ett mål och endast en lättare bekantskap med en part skulle troligtvis leda till ett orimligt resultat av domarbyten. En bedömning ska emellertid alltid ta hänsyn till samtliga omständigheter i varje fall, vilket kan leda till olika utslag i olika mål. En domare har ett förtroende av samhället att i sin yrkesroll bortse från ovidkommande hänsyn, vilket också måste vägas in i bedömningen.

Uppsatsen belyser vidare när en domare anses jävig då han tidigare medverkat i ett lagstiftningsarbete. Denna del har inte givits lika mycket utrymme i uppsatsen då den kommenterats mer sparsamt och helt enkelt vållat mindre problem. Omständigheten som sådan har sällan ansetts grunda ett jävsförhållande för en domare. Europadomstolen har dock i specifika fall kommit till ett annat resultat.

Avslutningsvis förs resonemang huruvida jävsregleringen idag är adekvat i sin nuvarande utformning. Jävsregeln kan idag framstå som svårtolkad med en i viss mån spretande och motsägelsefull praxis. Frågan kan därför lyftas om det borde införas riktlinjer för hur jävsreglerna ska tolkas.

Uppsatsen tar upp det faktum att jävsregeln i sällsynta fall kan leda till orimliga processekonomiska konsekvenser. Då jäv konstateras efter en meddelad dom finns idag inga andra möjligheter än att undanröja tidigare dom för att sedan ta om hela målet på nytt. Det finns enligt mig ett behov av en undantagsregel för att i extrema fall kunna undvika orimliga påfrestningar för rättsväsendet. Detta får givetvis inte riskera det förtroende som domstolen behöver för att utöva sin verksamhet. (Less)
