Möjligheten till häktning vid misstanke om brott regleras i svensk rätt av bestämmelserna i 24 kapitlet brottsbalken. Och där i huvudsak av första paragrafen som talar om för oss att häktning får ske om någon på sannolika skäl är misstänkt för ett brott som har ett år eller mer i straffskalan. Utöver detta så krävs det också att där finns en risk flykt-, kollusion- eller recidivfara.
Utöver att bli häktad så kan det även bli aktuellt med restriktioner i fall där åklagaren anser det nödvändigt för utredningen.
Både häktningen och restriktioner kan skapa psykisk ohälsa för den misstänkte. Av den anledningen är det viktigt att inte häktning och restriktioner använda av ren slentrian utan att det är proportionellt mot det utredningsvärde som... (More)

The possibility of detention if a crime is governed by Swedish law to the regulations of chapter 24 of brottsbalken. And where the first paragraph tells us that the detention may be used if someone with probable cause is suspected of a crime that has a year or more in the range of penalties. In addition, it also requires that there is a risk of escape, tampering of evidence or continued criminal activity.
In addition to being arrested, it may also be with restrictions in cases where the prosecutor considers it necessary for the investigation.
Both detention and restrictions can create mental health of the suspect. For this reason it is important to not put people in detention and give restrictions of pure routine without it being... (More)
