Både i Sverige och utomlands finns det ett behov av tvistlösning som alternativ till domstolsprövning. I Sverige har sedan 1917 Stockholms Handelskammares Skiljedomsinstitut fungerat som institut för alternativ tvistlösning genom skiljeförfarande och en gångbar lagstiftning på området har i Sverige funnits sedan 1929. Skiljeförfarandet som tvistlösningssätt präglas av fyra essentiella hörnstenar - skyndsamhet, ändamålsenlighet, partsvilja och sekretess. Denna redogörelse handlar om åtgärder för tillgodoseendet av två av dessa hörnstenar, nämligen skyndsamheten och ändamålsenligheten. I Sverige har sedan 1917 Stockholms Handelskammares Skiljedomsinstitut fungerat som institut för alternativ tvistlösning genom skiljeförfarande och en gångbar lagstiftning på området har i Sverige funnits sedan 1929. Skiljeförfarandet som tvistlösningssätt präglas av fyra essentiella hörnstenar - skyndsamhet, ändamålsenlighet, partsvilja och sekretess. Denna redogörelse handlar om åtgärder för tillgodoseendet av två av dessa hörnstenar, nämligen skyndsamheten och ändamålsenligheten. Uppsatsen behandlar nämligen särskilda skiljedomar och uppdelning av tvist inom ramen för skiljeförfaranden med säte i Sverige. Uppsatsen klargör för proceduren vid bestämmandet om och hur en tvist ska uppdelas till separata prövningar. Till denna uppdelning har skiljenämnden fått ett precist instrument att använda, den särskilda skiljedomen – skiljenämndernas laserkniv.

Inom radiokirurgin används laserknivar såsom ett av de mest precisa och kraftfulla instrumenten vid behandling av hjärnsjukdomar. En laserkniv koncentrerar sig på en särskild punkt och med ett precist ingrepp, avhjälper den det onda med hjälp av kirurgens determination. Laserkniven möjliggör alltså avhjälpande utan att hela huvudet vidöppnas. Även om detta instrument är utvecklat för användning inom medicinen, har detta precisa instrument en motsvarighet inom juridikens civilprocessrätt.

29§ i lagen (1999:116) om skiljeförfarande ger skiljenämnder möjligheten att utfärda så kallade särskilda skiljedomar som endast avgör en del av eller en viss fråga av betydelse för tvisten. Denna skiljedom har sin motsvarighet i den svenska rättegångsbalken (1942:740), då uppdelningsinstrumenten i stället benämnts deldom respektive mellandom. I lagen om skiljeförfarande intogs bestämmelserna med anledning av att de banade väg för processekonomiska vinster och att de i många fall ledde till ett mer välriktat domslut. Det är i den svenska skiljemannarätten relativt oklart vilken innebörd en uppdelning av tvist faktiskt har vilket är förenat med många praktiska problem. Denna uppsats redogör för vilka regler som gäller för uppdelning av tvist i skiljedom. Den redogör även för hur en sådan initieras och partsautonomins påverkan på skiljemännens processrättsliga befogenheter. Den framlägger även hur tema för särskild skiljedom bör formuleras utefter flertalet studerade skiljedomar. Rättsverkningar av och verkställighet för den särskilda skiljedomen redogörs också för i denna uppsats. Uppsatsen lägger även fram synpunkter på gällande rätt och rättegångsbalkens tillämpning på LSF. Råd till praktiker på området formuleras också.

Främst behandlar uppsatsen hur skiljenämnder kan och bör använda den laserkniv de fått till sitt förfogande. (Less)

In Sweden as well as in other countries, there is a need for alternative dispute resolution as supposed to dispute resolution through a court of law. The Stockholm Chamber of Commerce has functioned as an institute for alternative dispute resolution by arbitration since 1917, whereas passable regulations on arbitration have been in force since 1929. The arbitration as a method of dispute resolution is characterized by four essential cornerstones – speediness, effectiveness, party autonomy and confidentiality. In Sweden as well as in other countries, there is a need for alternative dispute resolution as supposed to dispute resolution through a court of law. The Stockholm Chamber of Commerce has functioned as an institute for alternative dispute resolution by arbitration since 1917, whereas passable regulations on arbitration have been in force since 1929. The arbitration as a method of dispute resolution is characterized by four essential cornerstones – speediness, effectiveness, party autonomy and confidentiality. This presentation deals with measures for the sake of maintaining two of the cornerstones, namely speediness and effectiveness. This thesis aims to clarify the whole procedure of determining if and how a dispute should be divided into separate portions when the seat of arbitration is Sweden. In doing this, the arbitrators have obtained a cutting-edge instrument, the separate award – their very own gamma knife.

Within the medicinal field of radio surgery, gamma knifes are used as one of the most precise and powerful treatment for brain disorders. A gamma knife focuses on one certain point and with a precise operation the surgeon relieves a patient from pain by determination. Hence, the gamma knife carries out relief sough without cracking open the primary concern, namely the head. Although the technique is developed to be used within the field of medicine, this highly effective tool has its bearing even in civil procedural law.

Section 29 of the Swedish Arbitration Act (1999:116) invests the arbitral tribunals with the authority of issuing so-called separate awards. Moreover, such separate awards decide only a part of or a certain issue of significance to the dispute. The separate award has its equivalent in the Swedish Code of Judicial Procedure (1942:117), in which they instead are named partial- or interim judgments. The possibility of issuing separate awards was incorporated into the Swedish Arbitration Act as it paved way for procedural cost efficiency and more materially accurate awards. However, apart from these reasons, when it comes to arbitration, the implications of such awards are rather vague which entails various practical issues.
This thesis, on the other hand, presents the rules applicable to the bifurcation of an arbitration. It also deals with the procedure of how such a bifurcation is initiated and how the party autonomy inflicts on the arbitrators procedural authority. Furthermore, it offers proposals on how to formulate the so called theme of a separate award. The legal effects of and the enforceability of such awards are also discussed. Moreover, the principles of governing commercial arbitration law in relation to the Swedish Code of Judicial Procedure are reviewed and problematized. Advice for practitioners of law is also presented on the subject.

All in all, the essay processes how arbitrators could and should use the gamma knife they have at their disposal. (Less)
