- Sammanfattning
En arbetsgivare kan i svensk och engelsk rätt bli ålagd ansvar för annans vållande. I svensk rätt
kallas denna lära för principalansvar och stadgas i 3:1 SkL. I den engelska rätten kallas ansvar för
annans vållande för vicarious liability och principen om en arbetsgivares ansvar har etablerats i
praxis. Ansvaret kan ses som strikt i den mening att en arbetsgivare själv inte måste ha varit
vållande. Det behöver inte röra sig om en anställds handlande utan flera små misstag begångna av
ett flertal anställda kan tillsammans nå upp till den grad av culpa som krävs för att en arbetsgivare
ska bli tilldelad ansvar. En arbetsgivare svarar alltså för sin organisation.

annans vållande för vicarious liability och principen om en arbetsgivares ansvar har etablerats i
praxis. Ansvaret kan ses som strikt i den mening att en arbetsgivare själv inte måste ha varit

Principalansvar är kontroversiellt och har gett upphov till en del rättspraxis och doktrin. Ansvar har
bland annat utdelats vid förskingringsbrott och för så kallade beroende uppdragstagare, vilket
grundar sig i motiven till principalansvaret. De bakomliggande syftena är i princip desamma inom
de två rättssystemen och det kan även vara en förklaring till deras likheter. Jag kommer i min
uppsats göra en framställning av de grundläggande förutsättningarna som krävs för att ansvar ska
bli aktuellt. Läsaren kommer att få en redogörelse för relevanta rättsfall, dessa kommer sedan att
jämföras med ett kritiskt perspektiv. Jag kommer i min slutsats fram till att likheterna mellan våra
rättssystem är många och ett flertal argument kan återfinnas i både den svenska och engelska
rättstillämpningen. Jag kan tyckas se ett mer långtgående principalansvar i det engelska systemet.

employer. For this reason the liability can be seen as strict. The tortious act can be done by a
number of employees, their acts can joint together inflict liability on the employer. The reason
behind this is the fact that an employer has responsibility for it´s enterprise.
The resonsibility is controversial and has led to many court cases and doctrines. The courts has
taken the view that a employer should be responsible even if the acts are considered to be criminal.
Liability can even be seen in cases where an independent contractor has been hired. The motives
behind the theory is the same in both legal systems and this is the answer to why the systems are so
alike in many aspects. I will in my description give the reader an introduction to relevant cases and
compare these with a critical perspective. Even if there are simularities I can see a tendency to put
an extended responsibility on the employer in the english legal system. This applies primarily when
it´s a conscious act of an employee or if the deed is considered to be criminal. (Less)
