Kan FN rädda barnen? En kritisk granskning av FN:s arbete rörande skyddet för barnsoldater

- Rekryteringen och användandet av barnsoldater regleras bland annat i TP I och II och i barnkonventionen med tillhörande fakultativa protokoll. Dessutom finns en mängd resolutioner från säkerhetsrådet på området. Tillsammans ger dessa instrument barn i väpnad konflikt ett visst skydd. Men fortfarande utnyttjas barn i stor utsträckning i konflikter, både av stater och av icke-statliga grupper.
I uppsatsen redogörs för en del av det folkrättsliga skyddet för barnsoldater och FN:s roll i arbetet med att hindra aktörer från att använda sig av barnsoldater. Uppsatsen fokuserar på IHL och mänskliga rättigheter och beskriver den reglering gällande skydd för barnsoldater som finns inom dessa rättsområden. Uppsatsen förklarar också varför barn... The paper focuses on IHL and human rights and the protection that falls within these legal branches of international law. The paper also explains why children are used in armed conflict and how the conflicts of today are different than what they were 50 years ago.
The applicable regulations are critisized and suggestions are given on how the continued work of the UN should proceed. The paper is concluded with a discussion on the effectivity of the regulations where the motives behind the UN:s work is questioned and the purpose of IHL is also discussed. (Less)
