Rysk roulette: Hur rättssäkra är språkanalyserna

Asylprövningen i Sverige sker i huvudsak utifrån reglerna i FPL, FL och UtlL. Tillsammans med internationella rättskällor och vissa allmänt accepterade rättsgrundsatser ska de säkerställa en snabb, rättvis och rättssäker prövning. Arbetet syftar till att granska hur den svenska asylprövningen förhåller sig till dessa regler.
Först granskas rätten att söka asyl, vad denna innebär och vilka regler som styr svensk asylrätt. Asylrätten är ett unikt rättsområde där särskilda hänsyn ska beaktas, och rätten att söka asyl anses vara en mänsklig rättighet. Genom att granska svensk och internationell lagtext tar arbetet upp under vilka omständigheter asyl beviljas i Sverige. Begreppet asyl förklaras, och regeln om ”Non-refoulement” beskrivs.

Arbetet syftar till att granska hur den svenska asylprövningen förhåller sig till dessa regler.
Först granskas rätten att söka asyl, vad denna innebär och vilka regler som styr svensk asylrätt. Asylrätten är ett unikt rättsområde där särskilda hänsyn ska beaktas, och rätten att söka asyl anses vara en mänsklig rättighet. Genom att granska svensk och internationell lagtext tar arbetet upp under vilka omständigheter asyl beviljas i Sverige. Begreppet asyl förklaras, och regeln om ”Non-refoulement” beskrivs.
Arbetet lägger därefter fokus på utredningen som föregår prövningen. Vissa arbetsregler fastställs och myndigheternas utredningsplikt förklaras mer ingående. Till hjälp tar arbetet upp två rättsfall som illustrerar hur utredningsplikten tolkats av domstolarna.
Principen om ”Benefit of the doubt” gås igenom. Principen innebär en bevislättnad för den sökande och ska förstås som att då vissa omständigheter inte går att utreda ska bristen av bevis tolkas till den sökandes fördel. Principen härleds till svensk och internationell rätt.
Därefter skärskådas språkanalysernas roll som utredningsmetod. De ifrågasätts vad gäller tillförlitlighet, tillkomst och användning.
Uppsatsen avslutas med en analys och en slutsats som sätter in språkanalyserna i en kontext av myndigheternas utredningsansvar och bevislättnadsregeln. (Less)

The asylum procedure in Sweden is mainly based on the regulations in FPL, FL and UtlL. Together with international sources of law and some commonly accepted judicial principles they are supposed to secure a quick, fair and legally certain trial. The essay aims to examine how the Swedish asylum procedure is relating to these rules.
The essay begins by examining the right to seek asylum, what this right means and what rules govern Swedish asylum law. The asylum procedure in Sweden is mainly based on the regulations in FPL, FL and UtlL. Together with international sources of law and some commonly accepted judicial principles they are supposed to secure a quick, fair and legally certain trial. The essay aims to examine how the Swedish asylum procedure is relating to these rules.
The essay begins by examining the right to seek asylum, what this right means and what rules govern Swedish asylum law. Asylum law is a unique legal field with certain considerations, and the right to seek asylum is considered a human right. By examining Swedish and international statutory texts the essay discusses under what circumstances asylum is granted in Sweden. The word asylum is explained and the term “Non-refoulement” is described.
Next the essay focuses on the investigation that precedes the trial. Some regulations are ascertained and the investigative responsibilities of the authorities are explained more thoroughly. Two cases are used to illustrate how the investigative responsibilities are interpreted by the courts.
The judicial principle “Benefit of the doubt” is explained. The principle carries an alleviation of the requirement of evidence for the applicant and is to be understood as when certain circumstances can’t be ascertained the lack of evidence should be interpreted as benefitting the applicant. The principle is derived from Swedish and international law.
Thereafter the role of the language analysis as an investigative method is reviewed. Their reliability, the method by which they are made and their use are questioned.

The essay ends with an analysis and a conclusion that puts the language analysis in a context of the investigative responsibilities of the authorities and the rule “benefit of the doubt”. (Less)
