Abstract (Swedish)
När jag kom i kontakt med begreppet gärningsculpa, som är en nödvändig brottsförutsättning, under mina straffrättsstudier här vid Lunds Universitet slogs jag av att det, såvitt gäller just gärningsculpan, krävs en icke oväsentlig bedömning av domstolarna som saknar adekvata riktlinjer.
I denna uppsats har jag därför försökt att:
A) Beskriva svensk straffrätt gällande den straffrättsliga konstruktionen gärningsculpa, såsom den beskrivs av straffrättsprofessorn Nils Jareborg,
B) Belysa den brist jag anser att konstruktionen innehåller, vilket är avsaknaden av en sammanhållen och enhetlig normativ teori gällande vilka handlingar eller underlåtenheter som kan anses utgöra tillåtet eller otillåtet risktagande, samt förklara varför detta... (More)

I denna uppsats har jag därför försökt att:
A) Beskriva svensk straffrätt gällande den straffrättsliga konstruktionen gärningsculpa, såsom den beskrivs av straffrättsprofessorn Nils Jareborg,
B) Belysa den brist jag anser att konstruktionen innehåller, vilket är avsaknaden av en sammanhållen och enhetlig normativ teori gällande vilka handlingar eller underlåtenheter som kan anses utgöra tillåtet eller otillåtet risktagande, samt förklara varför detta faktiskt är en brist, samt
C) Beskriva grunddragen en kandidat till ovan nämnda normativa teori, vilket jag gjort med hjälp av normativ etisk teori, därför att detta ämnesområde behandlar just den typ av teori som saknas i gärningsculpabedömningen. Att så faktiskt är fallet är också något jag argumenterar för i texten. Den teori jag finner vara mest lämpad för ändamålet är en konsekventialistisk teori som tar i beaktande alla berörda parters intressen. (Less)
Abstract
Upon coming into contact with the Swedish legal concept of "gärningsculpa" (roughly, negligence or carelessness pertaining to an act, which is a necessary condition for criminal liability), during my studies of criminal law at Lund University, I was struck by the fact that there is a rather substantial judgment to be made by the courts, that lacks proper guidelines.
In this paper I therefore attempt to do the following:
A) Describe Swedish criminal law in regards to the legal concept of "gärningsculpa" as described by Nils Jareborg, professor of criminal law,
B) Highlight a fault I believe this legal concept contains, which is the lack of a coherent and uniform normative theory as to what type of behavior can be classified as... (More)
Upon coming into contact with the Swedish legal concept of "gärningsculpa" (roughly, negligence or carelessness pertaining to an act, which is a necessary condition for criminal liability), during my studies of criminal law at Lund University, I was struck by the fact that there is a rather substantial judgment to be made by the courts, that lacks proper guidelines.
In this paper I therefore attempt to do the following:
A) Describe Swedish criminal law in regards to the legal concept of "gärningsculpa" as described by Nils Jareborg, professor of criminal law,
B) Highlight a fault I believe this legal concept contains, which is the lack of a coherent and uniform normative theory as to what type of behavior can be classified as acceptable or unacceptable risk-taking, as well as explain why this is indeed a problem, and
C) Present the “bare bones” of a candidate for the previously mentioned normative theory, which I have done using elements from normative ethical theory, as this field deals precisely in the type of normative theory missing in the concept of "gärningsculpa" – why this is indeed the case I explain more closely in my text. The kind of theory I find to be most fitting is a consequentialist one, which in some manner takes into account the interests of all relevant parties. (Less)
