Abstract
It has at times been a debate among media and legislators about the Swedish police officers dis-cretionary application and great room for interpretation when dealing with the Swedish act: the Act (1976:511) on arrest of intoxicated people, etc. (our translation) which in Swedish is short-ened: LOB. It has also been comments on the law's primary care purpose, which is strongly em-phasized in the act and its preparatory work, and if it is actually achieved through these types of arrests. It has at times been a debate among media and legislators about the Swedish police officers dis-cretionary application and great room for interpretation when dealing with the Swedish act: the Act (1976:511) on arrest of intoxicated people, etc. (our translation) which in Swedish is short-ened: LOB. It has also been comments on the law's primary care purpose, which is strongly em-phasized in the act and its preparatory work, and if it is actually achieved through these types of arrests. The goal of this study is to use stigma and organization theory and with perspectives on discretion, investigate Swedish police officers handling of LOB, and how the interaction with the social services works and manifests itself in these specific cases. We have also investigated what the possible discrepancy between regulators and practitioners is leading to for those who are working practically with the law, and what consequences the arrest has for the affected. The study was based on qualitative interviews with seven police officers and two social workers and also by assimilating the research available on the subject. We have been able to discern a number of factors that we believe may be the basis for the criticisms that exists against the way the law is being applied, from both external reviewers as from internal handlers. The acts arbitrariness, po-lice officers wide discretion and lack of clear and nationally laid down procedures when it comes to the handling of this type of cases and the subsequent interaction work together with social ser-vices are all contributing factors that determines that the care you receive depends on which re-gion you were arrested in, rather than who you are and what care you primarily need. We also believe that an LOB might have both positive and negative effect for the one being arrested mul-tiple times during a short time period. A view of himself as a member of this stigmatized group of assumed addicts may lead to him justifying a similar behavior as them, which may cause even more arrests. The police officers’ stigmatized view on the group may also have an effect on their work and what choices they make when dealing with LOB. (Less)
