Oavsättlig i statens tjänst - En garanti för oberoende?

Uppsatsen har som syfte att undersöka domare i svenska domstolar, professorer och andra statsanställdas anställningsskydd. Alla tre yrkesgrupper var tidigare anställda med fullmakt, vilket innebar att de i princip var oavsättliga. Domare har kvar den formen av anställning men statsanställda och professorer har förlorat möjligheten till fullmaktsanställnig och jag vill veta varför det är så. Genom att läsa offentliga utredningar och andra förarbeten till lagar har jag undersökt vilka idéer och argument som framförs där för att avskaffa eller behålla fullmaktsanställningar för de olika yrkesgrupperna. I de statsanställdas fall har jag kommit fram till att de var ca. 50 000 anställda vid olika myndigheter vilket var en stor grupp människor i samhället som behandlades arbetsrättsligt olikt resten av arbetsmarknaden. Vilka människor som var statsanställda hade också förändrats från tidigt 1800-tal då de flesta statsanställda var män från adeln. Tillsammans med fackförbundens vilja att de skulle få organisera sig fackligt innebar det att fullmaktsanställningen avskaffades. Professorernas förlust av sitt starka anställningsskydd kopplar jag till införandet av New Public Management i början av 1990-talet. Idéerna om att den offentliga verksamheten skulle bli mer som ett företag innebar för universiteten att professorerna skulle fokusera mer på utbildning och bli mer som en fabrik med studenter som kunder och examination som slutprodukt. Domares ställning har snarare stärkts sedan 1970-talet bland annat genom ett starkare skydd i regeringsformen. (Less)

The essay's purpose is to investigate the employment security of court judges, professors at the universities and other government officials. All three of these professions used to be employed by power of attorney by the government, which meant that they were more or less irremovable. Judges are still employed in this way, but government officials and professors have lost the right of employment by power of attorney and I want to know why. By studying Swedish Government Official Reports and other preparatory works which precedes laws I have investigated which ideas and arguments that has been put forward to justify the abolishment or retention of the employment by power of attorney in the different professions. The essay's purpose is to investigate the employment security of court judges, professors at the universities and other government officials. All three of these professions used to be employed by power of attorney by the government, which meant that they were more or less irremovable. Judges are still employed in this way, but government officials and professors have lost the right of employment by power of attorney and I want to know why. By studying Swedish Government Official Reports and other preparatory works which precedes laws I have investigated which ideas and arguments that has been put forward to justify the abolishment or retention of the employment by power of attorney in the different professions. In the case of the government officials I have reached the conclusion that there were almost 50.000 persons employed by government agencies and boards, which meant that there were a large group of people treated differently than the rest of the labour market. The composition of the group had changed from the early 19th century, when the government officials were males from the nobility. This, together with the trade unions eagerness to give the government officials the right to organize in the trade unions meant the abolishment of their employment by power of attorney. I connect the professors loss of employment by power of attorney to the introduction of New Public Management in the early 1990s. The ideas that the public services should be adapted to the workings of private companies meant that the universities and professors should focus more on education and become more like a factory with students as customers and degrees as the product. However, judges position has seemingly increased since the 1970s, among other things a strengthened protection in the Swedish Instrument of Government. (Less)
