I detta arbete undersöks brotten olaga förföljelse, som infördes år 2011 och grov kvinnofridskränkning, som infördes år 1998. Ingen av dessa bestämmelser kom att innebära någon nykriminalisering, utan medförde kort sagt att vissa redan straffbara gärningar kom att betraktas som ett brott då de utförts som led i en upprepad kränkning. Alternativet att nykriminalisera avfärdades i båda fallen som ogörligt, bland annat med hänsyn till straffrättens legalitetsprincip. Undersökningen tar sin utgångspunkt i dessa svårigheter att inlemma företeelserna stalkning och mäns våld mot kvinnor inom ramen för straffrätten. Syftet med arbetet är att identifiera de gemensamma problem som uppstått i införandet av dessa brott, och att försöka förstå dessa problem utifrån ett genusrättsligt perspektiv.

Det material som lagts till grund för uppsatsen utgörs i huvudsak av de förarbeten som lett fram till införandet av bestämmelserna. I undersökningen uppmärksammas i vilken mån det våld man velat motverka formulerats som individ- eller strukturrelaterat, som generellt eller specifikt. Därefter granskas de åtgärder mot problemen som presenterats i förarbetena och hur de följs upp i rättstillämpningen.

I analysdelen framkommer att det finns likheter mellan hur problemen behandlas i de båda lagstiftningsprocesserna. För det första avfärdas behovet av nykriminalisering med hänvisning till att det våld man velat komma åt omfattas av befintliga straffbud. För det andra konstrueras en bild av att krav på legalitet utesluter ett beaktande av våldsutsatta kvinnors intressen. För det tredje framträder en uppfattning om att kontext i straffrättsliga sammanhang endast är relevant i förhållande till en individualiserad gärning. Svårigheten att inlemma mäns våld mot kvinnor i straffrätten illustreras också av en ambivalent beskrivning av våldet som ömsom generellt och ömsom specifikt; ömsom strukturrelaterat, ömsom individrelaterat. Abstract
This essay examines the crimes Stalking enacted in 2011 and Violation of a woman’s integrity enacted in 1998. Neither of these regulations involved criminalisation of previously legal behaviour, but caused certain criminal actions to be treated as a specific crime when being part of a continued violation. The alternative to criminalise new behaviour was rejected in both cases as impossible, due to the principle of legality among other factors. The essay takes as it’s starting point these difficulties in incorporating the phenomena of stalking and men’s violence towards women in the criminal legal system. The purpose of the essay is to identify the common problems that were faced in the creations of these crimes, and to try to analyze these... (More)
This essay examines the crimes Stalking enacted in 2011 and Violation of a woman’s integrity enacted in 1998. Neither of these regulations involved criminalisation of previously legal behaviour, but caused certain criminal actions to be treated as a specific crime when being part of a continued violation. The alternative to criminalise new behaviour was rejected in both cases as impossible, due to the principle of legality among other factors. The essay takes as it’s starting point these difficulties in incorporating the phenomena of stalking and men’s violence towards women in the criminal legal system. The purpose of the essay is to identify the common problems that were faced in the creations of these crimes, and to try to analyze these problems from a gender perspective on law.

The material that the essay is based on is primarily the preparatory works to the regulations. It is examined to what extent the violence in question was formulated as a problem of individuals or as a structural problem; as a general problem or as a specific problem. Thereupon the legal measures proposed in the preparatory works are studied along with how these measures have been implemented by the courts.

The results show that there are similarities as to how the problems have been treated in the legislation procedures. Firstly, the need for further criminalisations is rejected on the ground that the violence in question is already covered by existing criminal law. Secondly, the need to respect the principle of legality is construed as an obstacle that renders it impossible to take notice of the specific situation of women who are victims of violence. Thirdly, contextualisation of the action is understood as possible only in connection to an individualised criminal act. The difficulty in incorporating men’s violence towards women in the criminal legal system is also illustrated by an ambiguous description of the violence as alternately general and specific; structural and individual.
