Straffbart att inte hjälpa?! Perspektiv på den svenska debatten om en civilkuragelag

- Som ett av få länder i vår närhet har Sverige valt att inte införa någon allmän lagstadgad plikt att hjälpa nödställd när detta kan göras utan risk för den egna hälsan. Syftet med förevarande uppsats har främst varit att utifrån olika rättsliga perspektiv belysa de avvägningar som aktualiserats i den svenska debatten om ett eventuellt införande av en civilkuragelag och också att försöka förklara varför en sådan inte införts. Nuvarande rättsläge mest sammanhörande med uppsatsens tema har klargjorts med hjälp av en rättsdogmatisk metod. - Som ett av få länder i vår närhet har Sverige valt att inte införa någon allmän lagstadgad plikt att hjälpa nödställd när detta kan göras utan risk för den egna hälsan. Syftet med förevarande uppsats har främst varit att utifrån olika rättsliga perspektiv belysa de avvägningar som aktualiserats i den svenska debatten om ett eventuellt införande av en civilkuragelag och också att försöka förklara varför en sådan inte införts. Nuvarande rättsläge mest sammanhörande med uppsatsens tema har klargjorts med hjälp av en rättsdogmatisk metod. En civilkuragelag kan ses som en utvidgning av den idag något oklara, och framförallt genom doktrin och praxis utformade, garantläran. Vad gäller den svenska debatten om en civilkuragelag har denna systematiserats och analyserats med hjälp av de rättsliga perspektiven rättspositivism respektive naturrätt. Utifrån ett rättspositivistiskt perspektiv talar fler skäl mot än för en civilkuragelag och de vanligast förekommande argumenten är sammanhörande med nytto- och effektivitetsresonemang. Enligt ett naturrättsligt synsätt är det betydligt enklare att argumentera för en civilkuragelag och det oftast återkommande argumentet är att lagstiftningen ska överensstämma med det allmänna rättsmedvetandet. Det, framförallt genom den s.k. Uppsalaskolan, starka rättspositivistiska inflytandet i Sverige är enligt uppsatsen en viktig förklaring till varför det fortfarande inte finns en straffbelagd allmän skyldighet att hjälpa nödställd i vårt land. Författaren har kommit till slutsatsen att argumenten för ett införande av en civilkuragelag är av sådan tyngd att detta bör göras i svensk rätt. (Less)

- As one of few countries in our proximity Sweden has chosen not to implement a general legal duty to rescue a person in distress when this can be done without risk of personal health. The main purpose with present essay has been to highlight, based on different legal perspectives/theories, the trade-offs which been actualized in the Swedish debate about the possible introduction of a “moral courage law”. An attempt to explain why this has not been done is also made. Current legal position mainly associated with the theme of the essay has been clarified using legal dogmatic method. A “moral courage law” can be seen as an extension of “the guarantor doctrine” which today is somewhat vague and designed particular by doctrine and practice. When... (More)

According to a natural law-perspective it is significantly easier to argue for a “moral courage law” and the most recurrent argument is that the legislation is supposed to be consistent with the general sense of justice. In Sweden there has been strong influence of legal positivism, in particular through the so called “Uppsalaskolan”, which according to this essay is an important explanation to why there still is not a punishable general obligation to help a person in distress in our country. The author has come to the conclusion that the arguments for implementing a “moral courage law” are so strong that this should be done in Swedish law. (Less)
