- Common-law husband genesis and changes are the product of a changing society and one can clearly see the legislators aim to follow this change. 100 years back in time, it would be unthinkable with the gender-neutral legislation in the common-law husband that exists today. The marriage was a matter of course and stood without competition and sex between same genders was a crime. Today there is this legislation that protects the rights for these parties.
As common-law husband have a purpose to create some form of justice, there are many opinions and thoughts on this. The aspect of justice in this case is all about how two economies that are linked together, will be separated and both parties will be prepared to move on with their lives.

What is justice? To always share equally even though one party has contributed more, and regardless of behavior towards each other? Not too often, there is dissatisfaction not just with one party but all too often in both parties. The "justice" to be created at a division of property included in the unit crowns. It's all about economics and money. The result for a division of property is the question of who should pay what for the other.
I have summarized the history of the common-law husband and how it has grown out of society's changing norms. I go through the rules of common-law husband, how it applies today and its results for the division of property with an emphasis on the financial results between the parties. I highlight the shortcomings and lead to opportunities to control the outcome in the desired direction. As well as the shortcomings which gives an unfair result in the end.
Common-law husband in its current form is not an end product but I am convinced that the changes will take place gradually and legislation will follow the changing requirements that the future will bring. (Less) - Abstract (Swedish)

Inte allt för ofta finns det missnöje inte bara hos den ena parten, utan allt för ofta hos båda parterna. Den ”rättvisa” som ska skapas vid en bodelning räknas i enheten kronor. Det handlar om ekonomi och pengar. Resultatet efter en bodelning är frågan om vem som ska betala vad till den andre.
Jag har sammanfattat historiken bakom sambolagen och hur den har växt fram ur samhällets skiftande normer. Jag går igenom reglerna för sambolagen hur den gäller idag och dess resultat efter bodelning med betoning på det ekonomiska resultatet mellan parterna. Jag belyser de brister som finns och som leder till möjligheter att styra resultatet i önskad riktning. Jag belyser de brister som ger ett oskäligt resultat vid bodelningen. Den kritik som finns mot sambolagens sakliga innehåll belyses och till viss del förklaras, samt problematiken med den övertro till sambolagens innehåll som finns bland människor.
Sambolagen i sin nuvarande form är inte en slutprodukt utan jag är övertygad om att förändringar kommer ske succesivt och lagstiftningen kommer följa de förändrade krav som framtiden har med sig. (Less)
