- Gross violation of a woman’s integrity is a crime that consists of multiple criminal acts. During the trial of gross violation of a woman’s integrity is it possible for the court to use legally binding judgements to fulfil the requisite repeated violation. The court does not use legally binding judgements to fulfil the requisite criminal acts. The purpose of this essay is to examine if the use of legally binding judgements could be an abuse of the principle ne bis in idem, the prohibition of double punishment.

During the trial of gross violation of a woman’s integrity is it possible for the court to use legally binding judgements to fulfil the requisite repeated violation. The purpose of this essay is to examine if the use of legally binding judgements could be an abuse of the principle ne bis in idem, the prohibition of double punishment.
The issue of possible double punishment was addressed in the government bill of the law. Both the government and the legal council were of the opinion that it would not be a violation of the principle ne bis in idem to consider acts already subject to a convictional sentence to fulfil the requisite repeated violation. This question was tried by the Supreme Court in NJA 1999 s. 102 not long after the adoption of the bill. The Supreme Court did not find any reason not to use legally binding judgment when trying the necessary requisite repeated violation.
This interpretation stands today. Swedish courts use legally binding judgments to qualify new acts as gross violation of a woman’s integrity.
I argue that the legal standing today is not completely satisfactory. I question if the precedent can be considered in conformity with ne bis in idem. A defendant suffers a risk of being sentenced for a more serious crime by the use of an already legally binding judgement. Other aspects of the criminalisation of gross violation of a woman’s integrity are also examined in the analysis.
My conclusion includes the suggestion of some kind of change of the current construction of the crime to avoid the risk of double punishment. In my analysis I present suggestions of such changes. (Less) - Abstract (Swedish)

Risken för dubbelbestraffning lyftes fram redan i propositionen till brottets införande. Regeringen och Lagrådet ansåg då inte att det stod i strid med ne bis in idem att använda sedan tidigare avdömda gärningar för att vid en senare prövning uppfylla rekvisitet upprepad kränkning. Problemet prövades i Högsta domstolen i målet NJA 1999 s. 102 snart efter införandet av lagbestämmelsen. Högsta domstolen fann inte heller att principen ne bis in idem utgjorde något hinder mot att använda tidigare lagakraftvunna domar vid bedömningen av rekvisitet upprepad kränkning.
Denna ordning kvarstår idag. Landets domstolar använder tidigare lagakraftvunna domar för att kvalificera nya gärningar som grov kvinnofridskränkning när det annars inte hade rört sig om en upprepad kränkning.
Enligt min mening är den nuvarande ordningen inte helt tillfredställande. Jag ställer mig frågande till om nuvarande praxis verkligen inte utgör en dubbelbestraffning. Den tilltalade riskerar att dömas till ett hårdare straff för de nya gärningarna på grund av en tidigare avdömd gärning. Ytterligare aspekter av tillämpningen av straffbestämmelsen behandlas också i analysen.
Jag anser att någon form av förändring av den nuvarande konstruktionen hade varit lämplig för att undvika dubbelbestraffande effekt, och jag ger i min analys förslag på sådan förändring. (Less)
