Abstract (Swedish)
Svenskt ställföreträdarskap för vuxna består av möjligheten att utse en god man eller förvaltare. Tidigare fanns en möjlighet att upprätta en fullmakt för någon som kunde hjälpa den enskilda även efter att denna p.g.a. ålder eller annan orsak inte längre var beslutsförmögen. Det förfarandet kritiserades på många håll, inte minst genom NJA 2015 s. 851. Av denna anledning pågår arbetet för att anta en ny lag, lag om framtidsfullmakter, vilken är tänkt att träda i kraft 1 juli 2017. Detta arbete syftar till att redogöra för huvud-punkterna i den nya lagen samt identifiera möjlig tillämpningsproblematik.

Tidigare fanns en möjlighet att upprätta en fullmakt för någon som kunde hjälpa den enskilda även efter att denna p.g.a. ålder eller annan orsak inte längre var beslutsförmögen. Det förfarandet kritiserades på många håll, inte minst genom NJA 2015 s. 851. Av denna anledning pågår arbetet för att anta en ny lag, lag om framtidsfullmakter, vilken är tänkt att träda i kraft 1 juli 2017. Detta arbete syftar till att redogöra för huvud-punkterna i den nya lagen samt identifiera möjlig tillämpningsproblematik.

Lagen är tänkt att ge enskilda en möjlighet att utse en fullmaktshavare som kan ta fullmakten i bruk när fullmaktsgivaren i en framtid inte längre har förmåga att ta hand om sina angelägenheter (ekonomiska eller personliga). Framtidsfullmakter ska vara mer reglerade än vanliga fullmakter och kommer omfattas av formaliakrav i form av skriftlighet samt solennitets-vittnen. Fullmaktshavaren ska handla i fullmaktsgivarens intresse i den omfattning som anges i fullmakten. Kontrollfunktionerna ska bestå av möjligheten att utse en ”granskare” samt överförmyndarnämndens tillsynsmöjlighet.

I den föreslagna lagen finns vissa aspekter värda att belysa som eventuella kommande problem. Det gäller bl.a. kravet på varaktighet i besluts-oförmåga, möjligheten till återkallelse, förhållandet mellan jäv och gåva, avsaknaden av tolkningsregler samt risken för missbruk och illojalt förfarande. Då lagen innehåller betydligt färre inslag av myndighetskontroll än övriga ställföreträdarskap är alla problemområden särskilt viktiga för att ge institutet den trovärdighet som behövs för att bli ett välanvänt rätts-instrument. Om problemområdena hanteras, antingen av den fortsatta utredningen eller av domstolarnas praxis, har detta nya institut alla möjligheter att fylla en lucka inom svensk rätt vilken den nu är i behov av. Swedish deputisation for adults comprises the possibility to designate an administrator or trustee. Earlier, there were a possibility to nominate a proxy agent to assist individuals with their affairs even after a they due to old age or any other reason not were able to. This procedure has become questioned, not least in the Swedish Supreme Court, NJA 2015 s. 851. Due to this reason, the Swedish government started a consultation for a new law, lag om framtidsfullmakter, which is set to become effective the 1 of July 2017. This thesis seeks to investigate and give an account of the primary content of the new legislation and thereto identify possible areas of risk.

This procedure has become questioned, not least in the Swedish Supreme Court, NJA 2015 s. 851. Due to this reason, the Swedish government started a consultation for a new law, lag om framtidsfullmakter, which is set to become effective the 1 of July 2017. This thesis seeks to investigate and give an account of the primary content of the new legislation and thereto identify possible areas of risk.

The new legislation is meant to give private citizens an opportunity to designate a proxy of their choice, which can start using the ”framtidsfullmakt” when the proxy principal no longer has the ability to care for their own affairs, economic or personal. The ”framtidsfullmakt” is supposed to be more regulated the normal proxies and will therefore have a form prescribed by law such as written form and two simultaneously present witness’s. The agent will act in the principal’s best interest. The external control will consist of the possibility to select an examiner of the principals own choice and the regulatory authority (överförmyndarnämnden).

In the proposed law, there is some noteworthy aspects that may cause problem in the future. For example the criteria ”long term” when speaking of decision inability, the possibility of revocation, the relationship between lawful disqualification and gifts, the lack of rules concerning judicial interpretation and the risk of misuse. Since the law lacks the amount of regulatory control that the other deputisation has, the problem areas become even more important to give this institute the credibility it needs to be a widely used legal instrument. If these problems are handled by the continued investigation or by the courts, this new institute has the possibility to fill the gap in Swedish law that right now needs to be filled. (Less)
