- Under 2015 sökte rekordmånga asyl i Sverige. För att minska antalet asylsökande till Sverige valde regeringen att införa den tillfälliga utlänningslagen. Majoriteten av remissinstanserna var kritiska till lagförslaget, men regeringen valde ändå att införa den tillfälliga lagen med motiveringen att det var nödvändigt att skapa andrum i svenskt asylmottagande. Den tillfälliga utlänningslagen innehåller tre stora förändringar jämfört med utlänningslagen. Majoriteten av remissinstanserna var kritiska till lagförslaget, men regeringen valde ändå att införa den tillfälliga lagen med motiveringen att det var nödvändigt att skapa andrum i svenskt asylmottagande. Den tillfälliga utlänningslagen innehåller tre stora förändringar jämfört med utlänningslagen. Den första förändringen är att flyktingar och alternativt skyddsbehövande ska beviljas tidsbegränsade uppehållstillstånd istället för permanenta uppehållstillstånd. Den andra förändringen är att endast flyktingar ska ha rätt till familjeåterförening. Den tredje förändringen är att permanent uppehållstillstånd endast får beviljas efter att det tidsbegränsade uppehållstillståndet har löpt ut om personen kan försörja sig.
I denna uppsats utreds om den tillfälliga utlänningslagen är förenlig med folkrätten och EU-rätten. Dessutom förs en diskussion kring hur den tillfälliga utlänningslagen kommer att påverka asylsökandes hälsa och nyanländas etablering i Sverige. Även en diskussion kring möjliga samhälleliga konsekvenser av införandet av den tillfälliga utlänningslagen förs i uppsatsen.
De slutsatser som redogörs för i uppsatsen är följande: att tidsbegränsade uppehållstillstånd är förenligt med folkrätten och EU-rätten; att alternativt skyddsbehövande omfattas av artikel 8 i EKMR och bör således också ha rätt till familjeåterförening; att asylsökandes hälsa och nyanländas etablering i Sverige kommer att påverkas negativt av bestämmelserna i den tillfälliga utlänningslagen. Dessutom dras slutsatsen att svenska staten kommer att få en ökad kostnad då myndigheternas arbetsbelastning kommer att öka i och med införandet av den tillfälliga utlänningslagen. (Less) - Abstract

The new law entered into force on 20th July 2016 and will be valid for three years. The law was adopted even though a majority of the consultative bodies were critical to the new law. The second change is that only family members of refugees are eligible for Swedish residence permits. The third change is that a person only can be granted a permanent residence permit if he or she can provide a living for him- or herself.
This thesis investigates if the new law is compatible with international law and European law. The effects of the new law on asylum seekers’ health will be discussed in the thesis, as well as the effects on the establishment possibilities in Sweden for those affected by the new law. There will also be a discussion about the possible larger socio-economic effects of the new law on Swedish society.
The findings that are presented in the thesis are the following: that temporary residence permits are compatible with international law and European law; that family members of people in need of subsidiary protection should be eligible for residence permits to move to Sweden, and; that asylum seekers’ health and their establishment in Sweden will be affected negatively by the new law. In addition, it will be highlighted that Swedish authorities will get an unforeseen increased workload because of the new law, which will lead, in turn, to higher costs for the Swedish society.
