- Denna uppsats behandlar frågan om enskilda har en rätt till ideellt skadestånd från staten till vid kränkningar av grundläggande rättigheter. Den analyserar praxis från Europadomstolen, HD och EU-domstolen och kommer fram till att gällande rätt idag skiljer sig åt beroende på om rättigheten finns i EKMR, 2 kap. RF eller EU-stadgan men att det finns goda skäl för att möjligheterna till ersättning bör vara mer lika varandra och att gällande rätt kanske är på väg mot en sådan utveckling.
Uppsatsen har också fokus på ett verkligt just nu pågående skadeståndsärende där öresundspendlare har krävt skadestånd från staten för att de anser att deras rättigheter kränkts genom införandet av ett transportörsansvar som gör att de måste uppvisa... Uppsatsen har också fokus på ett verkligt just nu pågående skadeståndsärende där öresundspendlare har krävt skadestånd från staten för att de anser att deras rättigheter kränkts genom införandet av ett transportörsansvar som gör att de måste uppvisa legitimation för att tillåtas resa in i Sverige från Danmark. Uppsatsen kommer fram till att det i gällande rätt finns möjligheter att få ersättning för sådana rättighetskränkningar som de påstår sig vara utsatta för. (Less) - Abstract
- This paper deals with the question if there is in Swedish law a right for individuals to optain non-percuniary damages from the state in cases of violation of fundamental rights. It analyzes the practice of the European Court of Human Rights, Högsta Domstolen and the European Court of Justice and finds that the law in force today differs depending on whether the rights are contained in the ECHR, Chapter 2 of Regeringsformen or the EU Charter of fundamental rights but also that there are good reasons for that the possibilities of compensation should be more similar to each other and that we might be heading for such a development.
The paper also focuses on a real liability case that is being adressed
during the time of writing. Øresund... Øresund commuters have demanded compensation from the state because they consider that their rights have been violated by the introduction of law that requires them to provide identification to be allowed to enter Sweden from Denmark. The paper concludes that there are possibilities in law to receive compensation for such rights violations that they claim to be infringed. (Less)
