- I min uppsats har jag studerat hur förtroendet för åklagaren har påverkat åklagarrollen och åklagarprofessionen. Jag har i uppsatsen utgått ifrån ett utvecklingsperspektiv där jag dels har tittat på rättsutvecklingen i form av hur åklagaren har fått allt större befogenheter och behörighet och dels har tittat på hur åklagarprofessionen påverkats i form av legitimitet, auktoritet och autonomi.
Vid min granskning har jag undersökt hur åklagaren har fått allt större befogenheter och behörighet att göra undantag från den absoluta åtalsplikten i form av åtalsunderlåtelse, förundersökningsbegränsning och strafföreläggande. Denna utveckling har varit möjlig på grund av ett allt större förtroende för åklagarna och deras kompetens. Ökade... Jag har i uppsatsen utgått ifrån ett utvecklingsperspektiv där jag dels har tittat på rättsutvecklingen i form av hur åklagaren har fått allt större befogenheter och behörighet och dels har tittat på hur åklagarprofessionen påverkats i form av legitimitet, auktoritet och autonomi.
Vid min granskning har jag undersökt hur åklagaren har fått allt större befogenheter och behörighet att göra undantag från den absoluta åtalsplikten i form av åtalsunderlåtelse, förundersökningsbegränsning och strafföreläggande. Denna utveckling har varit möjlig på grund av ett allt större förtroende för åklagarna och deras kompetens. Ökade befogenheter och behörighet har i sin tur lett till en större legitimitet och auktoritet för åklagarprofessionen men även en ökad autonomi då åklagaren blivit mer självständig.
I kontrast med detta har jag samtidigt, i den senare delen av min granskning, identifierat en annan slags utveckling som kan peka på ett minskat förtroende för åklagarna. Just nu pågår det ett arbete inom Åklagarmyndigheten som på olika sätt vill tydliggöra och försäkra sig om att åklagaren iakttar sin ålagda objektivitetsplikt. I uppsatsen diskuterar jag att detta förändringsarbete kan ha sin bakgrund i processerna mot Sture Bergwall. Följderna av det minskade förtroendet kan bli en minskad självständighet för åklagarna och sett utifrån åklagarprofessionen en minskad legitimitet, auktoritet och autonomi. (Less) - Abstract
- In my essay, I have studied how confidence in the prosecutor has influenced the prosecutor’s role and the prosecutorial profession. In the essay, I´ve used a development perspective, where I looked at both the legislative development, where the Prosecutor has received increasing mandate and privileges, and at the development of the prosecutorial profession in terms of legitimacy, authority and autonomy
During my review, I´ve examined how the prosecutor has acquired increasing mandate and privileges to derogate from the obligation to prosecute, in the form of abstention from prosecution, preliminary enquiry limitation and summary imposition of a fine. This development has been possible because of the increasing confidence in the prosecutor... (More) - In my essay, I have studied how confidence in the prosecutor has influenced the prosecutor’s role and the prosecutorial profession. In the essay, I´ve used a development perspective, where I looked at both the legislative development, where the Prosecutor has received increasing mandate and privileges, and at the development of the prosecutorial profession in terms of legitimacy, authority and autonomy
During my review, I´ve examined how the prosecutor has acquired increasing mandate and privileges to derogate from the obligation to prosecute, in the form of abstention from prosecution, preliminary enquiry limitation and summary imposition of a fine. This development has been possible because of the increasing confidence in the prosecutor and their competence. The increasing mandate and privileges has in turn led to a greater legitimacy and authority for the prosecutorial profession but also to a greater autonomy when the prosecutor becomes more independent.
In the latter part of my review have I however discovered a different kind of development that can point to a loss of confidence in the prosecutors. In the Public Prosecutor´s Office there is a lot of work going on to clarify and ensure that the prosecutors observe their duty of objectivity. In the essay, I discuss that this continuous work to change is due to the criminal trial procedures against Sture Bergwall. The consequences of the loss in confidence can led to a reduced independence for the prosecutors and to a reduced legitimacy, authority and autonomy for the prosecutorial profession. (Less)
