- Abstract
- This bachelor thesis aims to question the common assumption of the state as the primary human rights fulfiller. With the theoretical framework that the study adopts, which is inspired by Pogge’s institutional perspective on human rights fulfillment, and by applying a critical discourse analysis on the concept of ”Creating Shared Value” and the UN framework on business and human rights, the study examines what common textual practices can be found. The study also reviews in what ways CSV can create and uphold social institutions, which fulfill human rights. - This bachelor thesis aims to question the common assumption of the state as the primary human rights fulfiller. With the theoretical framework that the study adopts, which is inspired by Pogge’s institutional perspective on human rights fulfillment, and by applying a critical discourse analysis on the concept of ”Creating Shared Value” and the UN framework on business and human rights, the study examines what common textual practices can be found. The study also reviews in what ways CSV can create and uphold social institutions, which fulfill human rights. When analyzing the concept of CSV and the UN framework the study found that a common way of speaking of ”needs” and ”rights” between the two exists. At the same time, the study found that the concept of CSV tends to speak about corporations in the same way the UN framework speaks about governments. When reviewing the way actions and roles of the two agents were described in the material the study showed a similar outcome. When examining CSV the study noted that the concept is shaped by profit maximization, a thrive towards fulfilling needs and by globalization. In the closing chapter of the thesis the theory of rights fulfillment is critically discussed by elucidating the distinct state-centered perspective that Pogge, among others, adopts. Finally, the consequences of a shift in duty bearer, from state to corporation, are discussed on the basis of identity, power relations and authority. The discussion addresses some complex problems when an agent, like a corporation, operates outside of its traditional boundaries onto state ”domain”. This occurs because of the divided nature of the agents and their different systems of rules. (Less)

- Denna uppsats har till syfte att problematisera den vedertagna uppfattningen om staten som den primära rättighetsuppfyllaren. I studiens avslutande kapitel diskuteras teorin om rättighetsuppfyllelse kritiskt och belyser det mycket påtagliga stats-centrerade perspektiv som återfinns bland annat hos Pogge, vid beskrivning av vem om uppfyller mänskliga rättigheter. Till sist diskuteras vilka konsekvenser en förskjutning av skyldigheter, från stat till företag, medför med utgångspunkt i identitet, maktrelationer och auktoritet. Diskussionen visar på flera problematiker när en aktör som företag rör sig utanför sin traditionella domän och in på statens, detta på grund av de olika aktörernas skilda karaktär och regelsystem.
