Idrottens straffrättsliga särart - Om straffansvar vid våld mellan idrottsutövare

I dagens samhälle har våld mellan idrottsutövare blivit en alltmer naturlig del av idrotten. Dessa våldshandlingar mellan idrottsutövare vid idrottsutövning brukar kallas för kvalificerat idrottsvåld och uppfyller i många fall rekvisiten för misshandelsbrott enligt den allmänna rättsordningen. Det är däremot sällan fallen av kvalificerat idrottsvåld tas upp till prövning i allmän domstol och i de fall domstolsprövning blir aktuell, är det sällan straffansvaret tillämpas fullt ut.

Dessa våldshandlingar mellan idrottsutövare vid idrottsutövning brukar kallas för kvalificerat idrottsvåld och uppfyller i många fall rekvisiten för misshandelsbrott enligt den allmänna rättsordningen. Det är däremot sällan fallen av kvalificerat idrottsvåld tas upp till prövning i allmän domstol och i de fall domstolsprövning blir aktuell, är det sällan straffansvaret tillämpas fullt ut.

Denna särbehandling har gett upphov till frågan huruvida regleringen av straffansvar vid kvalificerat idrottsvåld är lämplig eller inte, vilket denna uppsats syftar till att belysa. Frågan har i uppsatsen problematiserats utifrån två aspekter. Dels förhållandet att fall av kvalificerat idrottsvåld som huvudregel inte ska prövas i allmän domstol och dels domstolsväsendets bedömning av straffansvar i de fall som ändå domstolsprövats.

Det råder en uppfattning om att idrottsrörelsen är en självständig verksamhet som ska vara oberoende av rättslig iblandning. Idrottsrörelsen har därför utvecklat ett internt normsystem, enligt vilket idrottsutövarens våld mot sin motspelare ska bedömas av idrottsdisciplinen själv i första hand. I de fall det kvalificerade idrottsvåldet prövas i allmän domstol har ansvarsfrihetsgrunderna social adekvans och samtycke, som utvecklats i doktrin samt praxis respektive finns stadgad i brottsbalken, fått betydelse för straffansvaret.

Regleringen har visat sig innebära både fördelar och nackdelar, för såväl brottsoffret som gärningspersonen. Särbehandlingen av det kvalificerade idrottsvåldet motiveras främst med de positiva effekterna som idrotten bidrar med i samhället. Samtidigt får brottsoffrets skyddsintresse, vilket den allmänna rättsordningen i detta fall är tänkt att skydda, ge vika. Svaret på frågan om den nuvarande straffansvarsregleringen för kvalificerat idrottsvåld bör revideras har visat sig svårbesvarad men lämpligheten av den intresseavvägning som gjorts måste ändå ifrågasättas. Abstract
In today’s society, violence between athletes has become a natural part of the sports activity. These acts of violence between the athletes and during the participation, are usually called qualified sports violence. In many cases, these acts also fulfill the necessary condition of assault under the legal system. However, these kind of cases are rarely being tried in general court, but in those cases where judicial proceedings occurs, the culpability is not often completely applied.

In today’s society, violence between athletes has become a natural part of the sports activity. These acts of violence between the athletes and during the participation, are usually called qualified sports violence. In many cases, these acts also fulfill the necessary condition of assault under the legal system. However, these kind of cases are rarely being tried in general court, but in those cases where judicial proceedings occurs, the culpability is not often completely applied.

This differential regulation has raised the issue whether the regulation of culpability regarding qualified sports violence is appropriate or not, which this essay aims to illustrate. In this essay, the issue has been problematized based on two different aspects. Firstly the fact that cases of qualified sports violence, as a general principle, should not be tried in the general court. Secondly the judical assessment of liability in those cases, where the judical proceedings has been tried despite the general principle.

There is an idea of the sports movement as an independent operation, which is free from legal control. Therefore, the sports movement, has established a separate legal system, where the violence between the athletes, first of all, should be judged by the sports movement itself. In those cases, where the qualified sports violence has been tried in the general court, it can be found that the consent and social adequacy, has been important as a freedom from liability.

The regulation has proved both advantages and disadvantages, for both the offender and the victim of crime. The differential regulation of qualified sports violence is based on the positive effects that sport contributes to the society. On the other hand, the interest of victim, which the legal system is supposed to protect, has to be yielded to the public interest. The question, if the regulation of culpability regarding to qualified sports violence should be revised or not, is difficult to answer but the adequacy of the weighing of interests must be questioned.
