Nyligen avgjordes ett mål i Arbetsdomstolen som handlade om en barnmorska som inte fått anställning på grund av att hon på religiösa grunder vägrar delta i utförandet av aborter. Hon menar att Sverige, genom att inte tillmötesgå hennes krav och anställa henne trots hennes vägran bryter mot religionsfriheten i artikel 9 och förbudet mot diskriminering i artikel 14 i den Europeiska konventionen om skydd för de mänskliga rättigheterna och de grundläggande friheterna

Hon menar att Sverige, genom att inte tillmötesgå hennes krav och anställa henne trots hennes vägran bryter mot religionsfriheten i artikel 9 och förbudet mot diskriminering i artikel 14 i den Europeiska konventionen om skydd för de mänskliga rättigheterna och de grundläggande friheterna
Denna uppsats syftar till att närmare utreda om Sverige, genom att inte tillåta samvetsgrundad vägran inom abortvård, faktiskt bryter mot konventionen. Detta görs genom att utreda hur Europadomstolen kan förväntas döma i frågan om de skulle ta upp målet med barnmorskan till prövning. Uppsatsen igenom förhåller sig utredningen till detta fall.
Arbetet redogör för rekvisiten i artikel 9 och 14 med förtydligande och stöd från Europadomstolens praxis samt doktrin. På de områden där ytterligare omständigheter kunnat ha betydelse för bedömningen har vidare utredning gjorts. Exempelvis har frågan om en europeisk samsyn på området redogjorts för. Med utgångspunkt i denna utredning har en prognos gjorts av hur Europadomstolens bedömning i detta fall skulle kunna göras.
Det är inte en enkel fråga att utreda då omständigheterna i det enskilda fallet alltid har stor betydelse när det handlar om mänskliga rättigheter och således är det svårt att förlita sig på tidigare rättsfall. I analysen nås slutsatsen att Sverige troligtvis inte kommer anses bryta mot konventionen. Den avgörande frågan verkar vara om Sverige tillåts en vid eller snäv margin of appreciation. (Less)

Recently a case was settled in the Swedish Labour Court. A midwife had lost out on an employment because of her religiously grounded refusal to participate in abortions. Her opinion is that Sweden, by not accomodating her demands so they could hire her despite of her refusal, has breached the right to religious freedom in article 9 and the prohibition of discrimination in article 14 of the European Convention on Human Rights.
This essay aims to investigate if Sweden, by not allowing conscientious objection, is in fact in breach of the convention. It is done by looking at the way the European Court of Human Rights could be expected to rule in the case with the midwife, if it were to do so. The investigation relates to this case throughout... Her opinion is that Sweden, by not accomodating her demands so they could hire her despite of her refusal, has breached the right to religious freedom in article 9 and the prohibition of discrimination in article 14 of the European Convention on Human Rights.
This essay aims to investigate if Sweden, by not allowing conscientious objection, is in fact in breach of the convention. It is done by looking at the way the European Court of Human Rights could be expected to rule in the case with the midwife, if it were to do so. The investigation relates to this case throughout the whole essay.
This essay describes the prerequisites of the relevant articles with further backing from previous rulings of the Court and doctrine. In the areas where additional circumstances could be of significance for the decision further investigation has been done. For example, the question of if a european agreement in the field exists has been regarded. Based on the information above a prognosis has been done over how the European Court of Human Rights would rule in this case.
It is not an easy question to answer since the circumstances in each specific case always is of great importance when it comes to human rights which makes it hard to trust the applicability of previous rulings. In the analysis, the conclusion that Sweden is probably not in breach of the convention is reached. The crucial question in this case seems to be if Sweden is allowed a wide or narrow margin of appreciation. (Less)
