När en person lämnar in sin asylansökan till Migrationsverket måste ett
beslut fattas förhållandevis snabbt. Migrationsverket ska i utredningen av en persons asylansökan ta ställning till den sökandes identitet. Det är upp till den enskilde att klarlägga sin ålder som en del av sin identitet. För många ensamkommande barn har detta blivit en svår bevisfråga då barnen ofta flyr sina hem under omständigheter vi här i Sverige knappt kan föreställa oss. När en person lämnar in sin asylansökan till Migrationsverket måste ett
beslut fattas förhållandevis snabbt. Migrationsverket ska i utredningen av en persons asylansökan ta ställning till den sökandes identitet. Det är upp till den enskilde att klarlägga sin ålder som en del av sin identitet. För många ensamkommande barn har detta blivit en svår bevisfråga då barnen ofta flyr sina hem under omständigheter vi här i Sverige knappt kan föreställa oss. För den sökande påverkas hanteringen av asylärendet om den sökande är under 18 år. De medicinska åldersbedömningar Rättsmedicinalverket på uppdrag av regeringen utför har därför blivit ett hjälpmedel som alltjämt används för att fastställa den sökandes ålder.
Den här uppsatsen kommer behandla problematiken som uppstår när
Migrationsverket ska avgöra åldern på ensamkommande barn som söker
uppehållstillstånd i Sverige.
Jag har med hjälp av rättsdogmatisk metod inledningsvis redogjort för
bevisprövningen i asylrättsmål. Detta gjordes med stöd i svensk lagstiftning och allmänna rättsprinciper med fokus på åldersbedömningsfrågan. Jag har steg för steg gått igenom utredningsskyldighet, utredningsbörda och bevisbörda för att till slut landa i bevisvärderingen och möjligheten att överklaga besluten. Därefter har jag studerat åldersbedömningar i gällande rätt. Först genom att gå in i regleringen på EU-rättslig nivå och sedan motsvarande regleringar i svensk gällande rätt, myndigheters riktlinjer för
åldersbedömning och slutligen praxis. Jag har vidare redogjort för hur de
medicinska åldersbedömningarna utförs i praktiken. Den avslutande delen
av avhandlingen rör kritiska perspektiv framförda av myndigheter, JO och
slutligen forskare genom vetenskapliga studier.
I analysen ges en systematisk genomgång för rättsläget för att i
slutdiskussionen föra en argumentation kring frågeställningen. (Less) - Abstract (Swedish)

migrant” by the administration rather than an “unaccompanied child” can
affect the child significantly in the asylum process. When a child is under 18

children. To establish the unaccompanied child’s, age the National Board of
Forensic Medicine impose medical examinations. This is done when
documentary evidence cannot make the identity probable.
This essay seeks to address the issues that arise when the Migration Agency
must establish the unaccompanied child’s age through medical
examinations.
I have initially described how the burden of proof is placed in asylum cases.
Swedish and EU legislation and general principles of law regulates this.
Central aspects of the Swedish criminal trial procedure, regarding matters of
evidence has been analyzed. Throughout the introduction to the subject, the
age assessment has been in constant focus. This essay systematically
reviews the duty to investigate, the burden of investigation and the burden
of proof. The assessment of evidence and the possibility of appeal is
thereafter made clear. I have studied the legislation of age assessments.
This first by showing how the age assessments have been expressed in both national and EU legislation. I have also tried to clarify Swedish case law
and guidelines from Swedish authorities on the subject. The final part of the
dissertation tries to reflect critical perspectives by Swedish authorities,
“Parliamentary Ombudsmen” and finally researchers through scientific
studies.
The analysis gives a systematic review of the legislation and seeks to round
up the essay in a personal discussion. (Less)
