- Denna uppsats undersöker jävsreglernas tillämpning vid betygssättning i grund- och gymnasieskola med enskild och kommunal huvudman. De betyg en elev erhåller kan ha stor betydelse för elevens framtidsutsikter, främst för möjligheterna till vidare studier. Därför är det av stor betydelse att betygssättningen är rättvis och att läraren som beslutar om betyget gör betygsbedömningen på ett sakligt och opartiskt sätt. Avseende betygssättning i fristående skolor finns det dock inga tillämpliga jävsregler som garanterar lärarens opartiskhet. I kommunala skolor gäller kommunallagens jävsregler på betygssättningen. Därför är det av stor betydelse att betygssättningen är rättvis och att läraren som beslutar om betyget gör betygsbedömningen på ett sakligt och opartiskt sätt. Avseende betygssättning i fristående skolor finns det dock inga tillämpliga jävsregler som garanterar lärarens opartiskhet. I kommunala skolor gäller kommunallagens jävsregler på betygssättningen. Vid betygssättning i grund- och gymnasieskola kan olika situationer uppkomma där den betygssättande läraren är jävig. Medan sakägar- och intressejäv generellt inte kan inträffa vid betygssättning i grund- och gymnasieskola omfattar generalklausulerna ett antal olika situationer. Det avgörande för bedömningen om jäv föreligger eller inte blir i dessa fall de individuella omständigheterna. I kommunala skolor där jävsreglerna är tillämpliga utgör reglerna såväl krav på lärare och rektor att beakta och undvika situationer där jäv är för handen som riktlinjer för att kunna upptäcka och undvika sådana jävssituationer. I fristående skolor förloras denna möjlighet och trots att regeringsformens krav på saklighet och opartiskhet är tillämplig riskerar avsaknaden av tillämpliga jävsregler att ha negativa följder. - This essay analyzes the rules on partiality and their applicability on grade decisions in elementary and upper secondary schools governed by a private entity or by a municipality. The grades a pupil obtains may have a great effect on his or her future, especially regarding prospects on more advanced studies. Therefore it is of great importance that the grading is just and that the teacher performs the grade assessment in an objective and impartial manner. Regarding the grading in schools governed by a private entity there are however no applicable rules on partiality that guarantee the impartiality of the teacher. - This essay analyzes the rules on partiality and their applicability on grade decisions in elementary and upper secondary schools governed by a private entity or by a municipality. The grades a pupil obtains may have a great effect on his or her future, especially regarding prospects on more advanced studies. Therefore it is of great importance that the grading is just and that the teacher performs the grade assessment in an objective and impartial manner. Regarding the grading in schools governed by a private entity there are however no applicable rules on partiality that guarantee the impartiality of the teacher. In schools governed by a municipality the rules on partiality in the Swedish municipality act are applicable. During the grading procedure in elementary and upper secondary schools different situations may occur in which the teacher is partial. Whereas partiality due to being party or having an interest in the matter generally doesn´t occur when making grade decisions in the elementary and upper secondary school, the general clauses in the legislation are applicable on a number of different situations. The individual circumstances of the case are the most decisive factor for the partiality assessment in these cases. In schools governed by a municipality where the rules of partiality are applicable, the rules may act as both requirements for the teachers and the principal to detect and avoid situations, in which the teacher may be partial, and as guidelines to avoid such situations. In schools governed by a private entity this possibility is lost and although the requirement in the instrument of government on objectiveness and impartiality is applicable, the absence of applicable rules of partiality may have negative effects.
