Finns det civilrättsliga skyddsåtgärder i svensk rätt? - En analys av den svenska implementeringen av förordning (EU) 606/2013

Abstract
On January 11th, 2015, Directive 2011/99/EU of the European Parliament and of the Council of 13 December 2011 on the European protection order and Regulation (EU) No 606/2013 of the European Parliament and of the Council of 12 June 2013 on mutual recognition of protection measures in civil matters entered force in the European union. Due to the complex nature of the regulation, supplementary legislation was needed to make the regulation applicable in practice. The purpose of this essay is to examine whether the Swedish national provisions are compliant with the requirements of the regulation.

On January 11th, 2015, Directive 2011/99/EU of the European Parliament and of the Council of 13 December 2011 on the European protection order and Regulation (EU) No 606/2013 of the European Parliament and of the Council of 12 June 2013 on mutual recognition of protection measures in civil matters entered force in the European union. Due to the complex nature of the regulation, supplementary legislation was needed to make the regulation applicable in practice. The purpose of this essay is to examine whether the Swedish national provisions are compliant with the requirements of the regulation.

The regulation is applicable to protection measures in civil matters that have been ordered by a competent authority in the country of origin. These protection measures shall be recognized in the other member states without any special procedure being required. There is, however, no requirement for the member states to introduce any new protection matters due to the introduction of the regulation. The Swedish government decided in their proposal of the supplementary provisions, that Swedish national law lacks civil protection measures in the sense of the regulation, and that therefore was no reason to introduce any supplementary provisions that enabled the application of Swe-dish civil protection matters abroad. The recognition process of foreign civil protection measures was limited to being merely more than a formality. The Swedish authorities that were consulted in the law-making process put forward critique against the proposed legislation in their statements of opinion (remissvar in Swedish), because the answer to the question whether there are Swedish civil protection matters or not was not clear, and that the proposed process of recognizing foreign protection matters did not fulfil the regulation’s requirement of practical effect.
The conclusion of this essay is that it is highly unlikely that civil protection measures exists in Swedish national law, as the wording of the law and its preparatory works rather implies that the government’s assessment is correct. The proposed process of recognizing foreign protection matters is, however, found to be irreconcilable with the regulation’s purpose of enabling a simple and rapid mechanism for the recognition of civil protection measures ordered in another member state. Den 11 januari 2015 trädde Europaparlamentets och rådets direktiv 2011/99/EU av den 13 december 2011 om den europeiska skyddsordern och Europaparlamentets och rådets förordning (EU) nr 606/2013 av den 12 juni 2013 om ömsesidigt erkännande av skyddsåtgärder i civilrättsliga frågor i kraft inom Europeiska unionen. På grund av sin natur behövdes kompletterande bestämmelser införas i svensk nationell rätt för att förordningen skulle kunna tillämpas i praktiken. Uppsatsens syfte är att utreda huruvida den svenska implementeringen av förordningen uppfyller de krav som förordningen ställer upp.

Uppsatsens syfte är att utreda huruvida den svenska implementeringen av förordningen uppfyller de krav som förordningen ställer upp.

Förordningen är tillämplig på civilrättsliga skyddsåtgärder som meddelats av en behörig myndighet i utfärdandelandet. Dessa skyddsåtgärder ska erkännas i de andra medlemsstaterna utan att något särskilt förfarande krävs. Dock in-förs inget krav på att medlemsstaterna ska införa några nya skyddsåtgärder med anledning av förordningen. Den svenska regeringen tog fasta på detta faktum och slog fast i sitt lagförslag till de kompletterande bestämmelserna att svensk rätt saknar civilrättsliga skyddsåtgärder i förordningens mening och att det därför saknades anledning att införa en ordning som möjliggör utländsk tillämpning av svenska civilrättsliga skyddsåtgärder. Gällande er-kännandet av utländska civilrättsliga skyddsåtgärder begränsades förfarandet till att närmast vara en formalitet. Remissinstanserna var kritiska till lagför-slaget på grunderna att frågan om civilrättsliga skyddsåtgärder i svensk rätt inte alls var helt klarlagd och att det införda förfarandet för erkännande av utländska civilrättsliga skyddsåtgärder inte var tillräckligt för att erkännandet skulle uppnå praktisk effekt, ett krav som ställs i förordningen.

Uppsatsens slutsats är att det är högst tveksamt om civilrättsliga skyddsåtgärder existerar i svensk nationell lagstiftning då ordalydelsen och förarbetena till de skyddsåtgärder som finns i svensk rätt snarast talar för att regeringens bedömning är korrekt. Däremot anses det valda förfarandet för erkännande av utländska civilrättsliga skyddsåtgärder strida mot förordningens syfte att främja en enkel och snabb mekanism för erkännande av civilrättsliga skydds-åtgärder som meddelats i en annan medlemsstat.
