- Denna uppsats syftar till att undersöka det så kallade parodiundantaget. Det upphovsrättsliga fenomenet innebär att ett bearbetat konstverk, i syfte att vara en parodi, faller utanför den ursprungliga upphovsrätten. Detta eftersom bearbetningen i egenskap av en komedibetonad prägel innehar ett i förhållande till sin förebild främmande innehåll och är därmed att anses som ett nytt och självständigt verk, oberoende av originalverkets upphovsrätt. Under en tid har parodi-undantaget varit föremål för en omfattande diskussion. Under en tid har parodi-undantaget varit föremål för en omfattande diskussion. Det beror främst på att det fortfarande är oklart hur parodiundantaget ska tillämpas vid ett eventuellt upphovsrättsintrång. Till följd av EU-domstolens avgörande i det s.k. Deckmyn-målet har parodiundantaget fått en förtydligad innebörd, vilket väckt frågan om huruvida upphovsrätten enligt svensk lag och rättspraxis, åtminstone i fråga om parodiundantaget, överensstämmer med gällande EU-lagstiftning. - This essay aims to investigate the so-called parody exception. The copyright phenomenon means that a processed artwork, in the purpose of being a parody falls outside the original copyright. Because of its form of parody, the processed artwork holds a foreign content in relation to the original and is thus considered a new and independent artwork, regardless of the copyright of the original. For some time, the parody exception has been the subject of major discussions. This is mainly because it is still unclear exactly how it should be applicable regarding economic and non-profit copyright infringement.
