Antifascism och självförsvar – Nödvärnsbedömningar i Kärrtorp och Möllevången

Mot bakgrund av att tidigare forskning indikerat möjligheten att nazister döms mildare än vänsteraktivister granskas två uppmärksammade hovrättsdomar: Svea hovrätt, mål B 4882-14, och Hovrätten över Skåne och Blekinge, mål B 2077-16. Nödvärnsinvändningar gällde i båda fall våld med kniv i en slagsmålssituation mellan nazister och antinazister i likartade situationer.

Hovrätternas bedömningar granskas med utgångspunkt i respektive hovrätts förståelse av händelseförloppet. Utifrån rådande praxis och doktrin analyseras om någon skillnad av betydelse kan noteras i bedömningen av de båda fallen.

Vissa avvikelser från praxis noteras hos hovrätterna, men ingen oegentlighet av betydelse för utgången i respektive mål framkommer.
Abstract
In view of the fact that previous research may indicate that nazis are being judged and sentenced milder than left wing activists, two courts of appeal cases are examined: Svea Court of Appeal, case B 4882-14 and The Court of Appeal over Skåne and Blekinge, case B 2077-16. The alleged acts of self defense in both cases involved violence with knives in a fights between nazis and antifascists in similar situations.

The assessments of the courts are examined on the basis of the respective courts' understanding of the course of events. Based on precedents, practice and doctrine, it is analyzed whether any difference of significance can be noted in the assessment of the two cases.
