Verbala kränkningar i hemmet – en grund för omhändertagande enligt 2 § LVU?

Abstract
My aim with this thesis was to study verbal abuse as an equivalent to psychological abuse in The Care of Young Persons Act (LVU). The primary focus was on verbal abuse in the home as a reason to take a child into protective custody according to LVU. I made a thematic analysis on 8 court cases, with the purpose to find how the Social welfare board and County administrative board reasoned, when it came to verbal abuse in the home. Theoretical tools for understanding this certain issue was public law principles. My aim with this thesis was to study verbal abuse as an equivalent to psychological abuse in The Care of Young Persons Act (LVU). The primary focus was on verbal abuse in the home as a reason to take a child into protective custody according to LVU. I made a thematic analysis on 8 court cases, with the purpose to find how the Social welfare board and County administrative board reasoned, when it came to verbal abuse in the home. Theoretical tools for understanding this certain issue was public law principles. The main issue of this thesis has been the fact that verbal abuse in the home can be difficult to detect and its consequences can be hard to predict. However, just like other types of abuse, verbal abuse can be detrimental to a child's well-being, and should not be taken lightly. The ambition of this thesis has not been to argue for more legal intervention in the lives of young people. My result indicates that public law principles affect the outcome of whether verbal abuse in the home will be understood as emotional abuse according to the law or not. Another important finding is that the social welfare board’s application affects which matter of law may be examined in court or not. If the social welfare board has not applied for LVU due to emotional abuse, even though emotional abuse may have occurred, the court will not try that question. (Less)

Syftet med denna uppsats var att studera verbala kränkningar som en motsvarighet till vad som beskrivs som psykisk misshandel i Lag (1990:52) med särskilda bestämmelser om vård av unga (LVU). Mitt huvudsakliga undersökningsområde var hur verbala kränkningar i hemmet hanterats vid beslut om förberedande av vård av unga med stöd av 1 och 2 §§ LVU. Jag gjorde en tematisk analys på 8 rättsfall med syftet att finna hur socialnämnden och förvaltningsrätten resonerat gällande betydelsen av verbala kränkningar i hemmet. Teoretiska verktyg för att förstå mitt syfte var offentligrättsliga principer.

Mitt huvudsakliga undersökningsområde var hur verbala kränkningar i hemmet hanterats vid beslut om förberedande av vård av unga med stöd av 1 och 2 §§ LVU. Det huvudsakliga dilemmat i denna uppsats har varit det faktum att verbala kränkningar i hemmet kan vara svåra att upptäcka och dess konsekvenser kan vara svåra att förutsäga. Precis som andra typer av misshandel kan verbala kränkningar skada barnets välbefinnande och bör därför tas på allvar. Ambitionen har inte varit att argumentera för fler rättsliga tvångsingripanden i ungdomars liv.

Mitt resultat indikerar att offentligrättsliga principer påverkar huruvida verbala kränkningar i hemmet kommer att förstås som psykisk misshandel i LVU:s mening eller inte. Ett annat viktigt resultat är att socialnämndens ansökan påverkar vilken rättslig fråga som kan granskas i domstol eller inte. Om socialnämnden inte har ansökt om LVU på grund av psykisk misshandel, trots att psykisk misshandel kan ha förekommit, kommer domstolen inte att pröva den frågan. (Less)
