Bevisvärdering av barns och vuxnas utsagor har länge varit ett omdiskuterat ämne där rättssäkerheten i domstolens fria bevisvärdering har ifrågasatts. I våldtäktsmål är det vanligt att stödbevisning saknas och att ord står mot ord. Hela åtalet tvingas då bygga på målsägandens utsaga, men hur duktig är egentligen domaren på att avgöra huruvida en utsaga är sann eller falsk? Har domaren den kunskap som erfordras?

Bevisvärdering av barns och vuxnas utsagor har länge varit ett omdiskuterat ämne där rättssäkerheten i domstolens fria bevisvärdering har ifrågasatts. I våldtäktsmål är det vanligt att stödbevisning saknas och att ord står mot ord. Hela åtalet tvingas då bygga på målsägandens utsaga, men hur duktig är egentligen domaren på att avgöra huruvida en utsaga är sann eller falsk? Har domaren den kunskap som erfordras?

Syftet med detta arbete är att genom en dagsaktuell rättsfallsstudie av hovrättens domar, belysa de rättssäkerhetsproblem som kan uppstå vid bevisvärdering i mål gällande våldtäkt mot barn, då ord står mot ord. Arbetet syftar även till att utröna vad domstolen, vid sin bevisvärdering, kan göra och bör tänka på för att dessa faror för rättssäkerheten ska kunna hanteras på ett tillfredsställande sätt. För att besvara arbetets syfte inleds arbetet med en bakgrund av vad som, enligt gällande rätt, är vägledande vid domstolens bevisvärdering. Här lämnas även en redogörelse för några av de mest grundläggande rättspsykologiska påverkansfaktorerna.

Huvuddelen av arbetet bygger på resultatet av den genomförda rättsfallsstudien. I studien ingår samtliga hovrätters avgöranden gällande våldtäkt mot barn, från perioden 1 januari – 31 oktober 2018, där ord står mot ord. Det bör här påpekas att studien är för liten för att några säkra slutsatser ska kunna dras. Undersökningen indikerar dock på att den fria bevisvärderingen, i barnvåldtäktsmål, kan medföra en hel del faror för rättssäkerheten. Trots att samtliga domstolar vid sin bevisvärdering utgår från en strukturerad metod baserad på HD:s upplistade trovärdighetskriterier, är det en hårfin linje mellan en friande och en fällande dom. Av betydelse för målets utgång kan bland annat bli vilken innebörd och vikt domaren lägger vid respektive kriterium, vilka erfarenheter domaren har sedan tidigare, vilken inställning domaren har till kravet på stödbevisning och hur högt beviskravet ställs. För att undvika rättssäkerhetsproblem är det viktigt att lika fall behandlas lika och att domaren gör en så objektiv och förutsebar bedömning som möjligt. Domstolen måste bli tydligare i sina domskäl och ett tydliggörande från HD avseende hur stödbevisning ska bevisvärderas hade varit önskvärt. För att avgörandena ska bli så rättssäkra som möjligt är det även nödvändigt att domarens erfarenheter kompletteras med rättspsykologisk kunskap, bearbetade uppfattningar, kontinuerliga vidareutbildningar och andra kvalitetssäkrande processer. In rape cases it is common that they lack direct evidence. The entire prosecution is then forced to build on the complainant’s statement, but how accurate is the judge in determining whether a statement is true, or false? Evaluation of evidence of children's and adults' statements has, for a long time, been a controversial subject where the legal certainty in the court's free evaluation has been in question. In rape cases it is common that they lack direct evidence. The entire prosecution is then forced to build on the complainant’s statement, but how accurate is the judge in determining whether a statement is true, or false? Does the judge have the required knowledge?

The purpose of this essay is, through a case study of judgements from the court of appeal, to highlight the legal insecurities that may arise in the evaluation of evidence in cases involving child rape, when lack direct evidence. The essay also aims to identify what the court should take cognizance of, and can do, in order to be able to manage these legal insecurities in the best possible way. In order to answer the purpose of the essay, the essay begins with a background of what kind of rules the currant legislation establishes about evaluation. The background will also contain a description of some of the most common psychosocial factors that may affect the legal process and the children’s conduct and statements.

The main part of the work is based on the results of the case law study. The study includes all court judegements on rape against children, from January 1 to October 31 2018, where word stands against word and direct evidence is missing. The author is aware that the study is too small for absolute conclusions to be drawn. However the case law study indicates that the free evaluation of evidence propounds numerous legal insecurities. Even though all courts base their evaluation on a structured approach, based on the supreme courts’ credibility criterias, it is a subtle line between a verdict of acquittal and a verdict of guilty. Of importance for the decision making process are for instance; what meaning and weight the judge puts into each credibility criteria, the judge’s past experiences, what attitude the judge has to the lack of evidence and how much proof he, or she, thinks is required. In order to avoid dangers for the legal certainty, it is important that similar cases are treated equally and that judges makes as objective and predictable assessments as possible. The court must become clearer in its judgment. It’s also necessary to have a clarification from the supreme court regarding how assessments should be done when direct evidence is lacking. In order to make the judgments as legally secure as possible, it’s also necessary that the judge's experiences are supplemented with legal psychological knowledge, processed perceptions, further education and other quality assurance processes.
