I ett samhälle med begränsade resurser eftersträvas naturligen effektivitet i brottmålsprocessen, exempelvis genom mindre resurskrävande brottsutredningar. Vid en lagändring 2015 lagfästes möjligheten till strafflindring för en gärningsperson som väljer att medverka vid utredningen av sitt eget brott. Strafflindring kan aktualiseras om gärningspersonen lämnar uppgifter som är av väsentlig betydelse för utredningen av brottet. Syftet med strafflindringsgrunden var delvis att förfarandet öppnar upp för effektivare brottsutredningar och snabbare lagföring. Vid en lagändring 2015 lagfästes möjligheten till strafflindring för en gärningsperson som väljer att medverka vid utredningen av sitt eget brott. Strafflindring kan aktualiseras om gärningspersonen lämnar uppgifter som är av väsentlig betydelse för utredningen av brottet. Syftet med strafflindringsgrunden var delvis att förfarandet öppnar upp för effektivare brottsutredningar och snabbare lagföring. I samma bestämmelse som medverkan vid brottsutredningen, 29 kap. 5 § 5 p. BrB, regleras strafflindringsgrunden frivillig angivelse – som möjliggör strafflindring för en gärningsperson som väljer att frivilligt ange sig för brott. Strafflindringsgrunderna tillhör en grupp av billighetsskäl, vars syfte är att tillmäta omständigheter efter brottet eller gärningspersonens personliga förhållande betydelse vid påföljdsbestämningen.

En gemensam nämnare som kan förekomma vid både frivillig angivelse och medverkan vid brottsutredningen är att angivelsen eller medverkan kan ses som ett erkännande av brott. Utifrån uppsatsens syfte klargörs dels hur strafflindringsgrunderna förhåller sig till varandra, och hur erkännandet kan utgöra en gemensam grund, dels hur frivillig angivelse, medverkan i brotts-utredningen respektive erkännande processekonomiskt kan påverka effektiviteten av brottmålsprocessen.

Framställningen visar att processekonomiska vinster kan göras på olika stadier i brottmålsprocessen utifrån gärningspersonens agerande genom frivillig angivelse respektive medverkan vid brottsutredningen. Mest processekonomisk vinst kan göras vid ett fullständigt erkännande från gärningspersonen, där krav om straffnedsättning inte framställs. Detta eftersom processekonomisk vinst främst kan göras vid användande av summariska förfaranden, såsom strafföreläggande, och vid förekomsten av billighetsskäl bör ett mål underställas domstolsprövning. In a society with limited resources, efficiency is naturally sought in the criminal trial procedure, for example through less resource-intensive criminal investigations. The possibility for an offender to receive mitigation of a sentence by participating in the investigation of their own crime was introduced in Swedish law by an amendment of a law in 2015. Mitigation of a sentence can become relevant if the offender submits information that is of crucial importance for the investigation of the crime. Both voluntary denunciation and participating in the criminal investigation belongs to a group of equity factors, whose purpose is to attach circumstances after the offense or the offender’s personal circumstances importance in the determination of the penalty.

A common denominator that may occur in both voluntary denunciation and participation in the criminal investigation is that the statement or participation can be seen as a confession of crime. Based on the purpose of the essay, it is clarified, firstly, how voluntary denunciation and participation in the criminal investigation relate to each other, and how a confession can constitute a common ground, partly how voluntary denunciation, participation in the criminal investigation and confession process economically can affect the effectiveness of the criminal trial procedure.

The result shows that process economic gains can be made at various stages in the criminal trial procedure based on the offender’s actions through voluntary denunciation or participation in the criminal investigation. Most procedural profit can be made in the case of a full confession from the offender, where claims for penalty reduction are not made. This is because procedural profit can mainly be made when using summary procedures, such as summary imposition of a fine, and in case of equity factors, a case should be subject to judicial proceedings.
