Erkännandet av stater - om den svenska regeringens förhållningssätt till Palestina och Somaliland

Uppsatsen undersöker hur erkännandet av stater regleras, både inom folkrättsliga och svenska internrättsliga sammanhang. Vidare undersöker uppsatsen hur den svenska regeringen har argumenterat i förhållande till erkännandefrågor. Detta sker genom att undersöka fallet Palestina och fallet Somaliland.

Inom folkrätten har den deklaratoriska teorin och de kriterier som uppställs i Montevideokonventionen betraktats som särskilt betydelsefulla vad gäller erkännandet av stater. Det är dock oklart huruvida detta traditionella legala ramverk har kommit att ersättas, eller i alla fall utmanas, av mer nutida och normativa kriterier.

Utredningen i uppsatsen visar dock på att politiska aspekter har ansetts vara minst lika betydelsefulla i de fall där regeringen valt att tillerkänna en entitet statsstatus.

Den argumentation som har framförts av regeringen i ljuset av erkännandet av stater har varit av olika typ och dignitet. Politiska och folkrättsliga argument har ofta presenterats tillsammans. De folkrättsliga argumenten verkar dock inte vara avgörande i erkännandebesluten, utan de nyttjas snarare i syfte att legitimera regeringens ståndpunkt och beslut. (Less)

This essay examines how the recognition of states is regulated within the context of international law as well as within Swedish state law. Furthermore, the essay investigates how the Swedish government has argued in regard to questions of state recognition by examining the cases of Palestine and Somaliland.

Within international law, the declaratory theory and the statehood criteria defined in the Montevideo Convention have been especially important when determining whether or not an entity should be recognized as a sovereign state. It is however unclear whether this traditional legal framework has come to be replaced, or at least challenged, by criteria of more contemporary and normative character.

In Swedish state law, the foundations of the regulation of the recognition of states can be found in the 10th chapter of The Constitution of Sweden and state practice. Principles stemming from international law have been considered significant regarding the recognition of states. Nonetheless, this essay argues that political aspects have been equally important when the Swedish government has decided to recognize a state.

The arguments that have been presented by the Swedish government in matters concerning state recognition have varied in type and dignity. Political arguments and arguments based on international law have often been presented in the same context. However, this essay argues and concludes that legal arguments often are presented in order to legitimize the recognitional decision, rather than to determine it. (Less)
