Hur hamnade vi här? – Om förslaget att inskränka strejkrätten

De senaste åren har strejkrätten varit uppe på agendan i offentlig debatt och media. Efter en tid av utdragna konflikter på containerterminalen i Göteborgs hamn tillsatte regeringen en utredning för att undersöka möjligheten och lämpligheten att inskränka arbetstagares och arbetstagarorganisationers rätt att vidta stridsåtgärder i vissa situationer.
Syftet med uppsatsen är att analysera hur den föreslagna lagstiftningen legitimeras i departementspromemorian. Genom att använda diskursanalytisk metod baserad på Ernesto Laclau och Chantal Mouffes diskursteori undersöks i analysen hur behovet av lagstiftning konstrueras genom begreppet svenska modellen och representationen av arbetsmarknadens parter. Efter en tid av utdragna konflikter på containerterminalen i Göteborgs hamn tillsatte regeringen en utredning för att undersöka möjligheten och lämpligheten att inskränka arbetstagares och arbetstagarorganisationers rätt att vidta stridsåtgärder i vissa situationer.
Syftet med uppsatsen är att analysera hur den föreslagna lagstiftningen legitimeras i departementspromemorian. Genom att använda diskursanalytisk metod baserad på Ernesto Laclau och Chantal Mouffes diskursteori undersöks i analysen hur behovet av lagstiftning konstrueras genom begreppet svenska modellen och representationen av arbetsmarknadens parter. För att göra detta fokuserar analysen på centrala begrepp som används i departementspromemorian för att se hur de används och vilken betydelse de tillskrivs. I analysen används även kontrasterande perspektiv från debattartiklar och remissyttranden för att förtydliga diskursens mönster. Uppsatsens slutsatser bygger på en dikotomi mellan fred och konflikt, där fredsplikt och andra positivt betingade tecken legitimerar lagstiftning genom att knytas till den svenska modellen. Arbetsgivare framställs som utsatta och skyddsvärda då de redan tar det ansvar som förväntas av dem, medan representationen av arbetstagare bygger på konfliktsökande och misstänkliggörande. Stridsrätten och arbetstagarsidan framställs som ett hot mot den ordning som den svenska modellen representerar. (Less)
Abstract
The right to undertake industrial actions has been subject for public discussion in Sweden the past years. After a long period of conflict in the port of Gothenburg the government appointed an enquiry to investigate the possibility and suitability to restrict the rights to undertake industrial actions in certain situations.
The aim of this thesis is to analyse how the proposed legislation is legitimized in the memorandum. By using the method of discourse analysis, based on Ernesto Laclau and Chantal Mouffe's discourse theory, the thesis examines how the necessity for legislation is constructed through the term the Swedish model and the representation of the social partners. The right to undertake industrial actions has been subject for public discussion in Sweden the past years. After a long period of conflict in the port of Gothenburg the government appointed an enquiry to investigate the possibility and suitability to restrict the rights to undertake industrial actions in certain situations.
The aim of this thesis is to analyse how the proposed legislation is legitimized in the memorandum. By using the method of discourse analysis, based on Ernesto Laclau and Chantal Mouffe's discourse theory, the thesis examines how the necessity for legislation is constructed through the term the Swedish model and the representation of the social partners. The analysis focuses on central terms used in the memorandum to see how they are used and what significance they are assigned. Throughout the analysis contrasting perspectives from debate articles and comments on the memorandum are used to clarify certain patterns of the discourse. The conclusions proceeds from a dichotomy between peace and conflict where industrial peace among other positive terms legitimizes legislation by being tied to the swedish model. Employers is depicted as exposed and in need of protection seeing that they already take the expected responsibility, while the representation of employees is based on conflict and suspicion. The right to undertake industrial actions appears as a threat to the order that is represented by the swedish model. (Less)
