Intersektionalitet i Diskrimineringslagen - Utsikter för ett mer inkluderande diskrimineringsskydd

Abstract
The thesis explores intersectionality from a legal perspective and asks the question of whether an intersectional basis of discrimination considering international law can be implemented in the Swedish Discrimination Act. In recent socio-legal research, a theory of intersectionality organized around nodes has been developed. The theory is used to identify how intersectionality should be implemented taking into account the hierarchies that are established as a consequence of a one-dimensional perspective on discrimination. Furthermore, the theory is used in the analysis of the source material. The international and Swedish discrimination law, as well as the existing grounds for discrimination and case-law, are described and analyzed.

The result shows that intersectionality is best implemented if the purpose of the discrimination laws is built on the basis of central human rights conventions which raise a material equality perspective. Furthermore, it is shown that an open list is necessary for the foundation to be implemented in Swedish legal order. (Less)

Uppsatsen utforskar intersektionalitet ur ett rättsligt perspektiv samt ställer frågan om en intersektionell diskrimineringsgrund med beaktande av internationell rätt kan genomföras i den svenska diskrimineringslagen. Inom aktuell socio-legal rättsforskning har en teori om intersektionalitet som organiserat kring noder utvecklats. Teorin används för att identifiera hur intersektionalitet bör implementeras med hänsyn tagen till de hierarkier som etableras som en konsekvens av ett endimensionellt perspektiv på diskriminering. Vidare används teorin i analysen av källmaterialet. Den internationella och svenska diskrimineringsrätten samt de nu gällande diskrimineringsgrunderna och viss praxis skildras och analyseras.
