Straffrättslig ansvarsfrihet för våldsgärningar företagna inom idrottsutövning

Abstract (Swedish)
I uppsatsen berör jag regleringen om ansvarsfrihetgrunder för våldsgärningar företagna inom ishockey och jämförlig kontaktidrott. Jag undersöker om det uppmärksammade Liljafallet har förtydligat gällande rätt och om regleringen kan anses rättssäker och förutsebar. Ansvarsfrihetsgrunderna som kan motiverar tillåtlighet i annars brottsliga våldsgärningar är den oskrivna undantagsregeln enligt läran om social adekvans och samtyckesregeln i 24 kap. 7 § brottsbalken. Grunden för ansvarsfrihet är att det finns ett godtagbart samhälleligt intresse som gör att straffstadgandet får stå tillbaka respektive att giltigt samtycke har lämnats av den gärningen riktas mot.

I uppsatsen berör jag regleringen om ansvarsfrihetgrunder för våldsgärningar företagna inom ishockey och jämförlig kontaktidrott. Jag undersöker om det uppmärksammade Liljafallet har förtydligat gällande rätt och om regleringen kan anses rättssäker och förutsebar. Ansvarsfrihetsgrunderna som kan motiverar tillåtlighet i annars brottsliga våldsgärningar är den oskrivna undantagsregeln enligt läran om social adekvans och samtyckesregeln i 24 kap. 7 § brottsbalken. Grunden för ansvarsfrihet är att det finns ett godtagbart samhälleligt intresse som gör att straffstadgandet får stå tillbaka respektive att giltigt samtycke har lämnats av den gärningen riktas mot.

Jag utröner gällande rätt vad gäller ansvarsfrihet som motiveras genom läran om social adekvans och samtyckesregeln generellt men också specifikt för våldsgärningar som företas under idrottsutövning. Genom att studera den juridiska doktrin, de inte så genomarbetade lagförarbetena samt Liljafallet kommer jag fram till att Liljafallet har förtydligat gällande rätt. Jag tycker mig kunna utläsa att samtyckesregeln kan motivera regelrätta gärningar förutsatt att deltagandet är frivilligt. Jag kommer också fram till att den oskrivna undantagsregeln kan motivera ansvarsfrihet i fall att våldsgärningen utgör en regelöverträdelse men fortfarande håller sig inom spelets idé. Det berör handlingar som anses påräkneliga för respektive idrott. Uppsåtligt våld som går bortom spelets idé och regler samt leder till allvarliga skador åtnjuter inte idrottens straffrättsliga särställning.

Jag gör en kritisk analys av rättsreglerna utifrån rättssäkerhet, som enligt Åke Frändberg betyder ett rättssystem som tillhandahåller klara, tydliga och pålitliga svar på rättsliga frågor. Jag kommer slutligen fram till att regleringen inte är rättssäker och förutsebar gällande gärningar strider mot idrottens regelverk. Denna slutsats drar jag eftersom undantagsregeln som kan träffa dessa fall inte är lagstadgad och brister gällande tydlighet bland annat gällande hur en ska avväga huruvida gärningen är påräknelig eller inom idrottens ram. Jag drar vidare slutsatsen att utfallet vid en sådan prövning inte är förutsebar för den enskilda utövaren. (Less)
Abstract
In the essay I examine the regulation on excluding criminal liability for
assaults conducted by a player towards another player, while playing ice
hockey and comparable contact sports. I investigate whether the precedent
“Liljafallet” has clarified the applicable law and whether the regulation can be regarded as legally secure and if it is predictable for the individual athlete. The rule of consent in Chapter 24 7§ brottsbalken and the unwritten ground for excluding liability can justify otherwise criminal assaults. The basis for that is that there is an acceptable social interest in the positive effects of sports that motivates the act to be legal respective due to valid consent.

In the essay I examine the regulation on excluding criminal liability for
assaults conducted by a player towards another player, while playing ice
hockey and comparable contact sports. I investigate whether the precedent
“Liljafallet” has clarified the applicable law and whether the regulation can be regarded as legally secure and if it is predictable for the individual athlete. The rule of consent in Chapter 24 7§ brottsbalken and the unwritten ground for excluding liability can justify otherwise criminal assaults. The basis for that is that there is an acceptable social interest in the positive effects of sports that motivates the act to be legal respective due to valid consent.

I evaluate the law with regard to the exclusion of criminal liability
motivated by social adequacy and the rule of consent generally, but also
specifically for assaults that are carried out during sports. By studying the legal doctrine, the not so elaborated law work and “Liljafallet”, I come to the conclusion that “Liljafallet” has clarified the law in some ways. I able to conclude that the rule of consent can justify actions that are allowed according to the rules of a the sport, if participation is voluntary. I also come to the conclusion that the unwritten ground of for excluding liability can exclude liability if the assault constitutes a violation of the rules but still remains within the idea of the game. It concerns acts that are considered probable for each sport. Intentional violence that is considered beyond the game's idea and rules and leads to serious injuries does not obtain sports the special position within criminal law.

Lastly I make a critical analysis of the legal rules based on the rule of law, which according to Åke Frändberg means a legal system that provides clear, distinct and reliable answers to a legal issues. Furthermore, I come to the conclusion that the regulation is not legally secure and predictable regarding assaults that constitutes a violation of the rules of the sport. I make this conclusion because the unwritten ground for excluding liability that could be applicable for these cases is not statutory and lack of clarity in how to consider if the assault is probable when playing the sport or if the assault could be considered as an act within the idea of the game. Finally, I conclude that the outcome of a trial is not predictible for the individual athlete. (Less)
