Kronvittne som strafflindringsgrund - Kan ett kronvittnessystem knäcka den organiserade brottsligheten?

Den organiserade brottsligheten ökar i Sverige och skördar fler dödsfall varje år. Brotten är svåra att utreda då de ofta sker gränsöverskridande och med tekniska hjälpmedel. Vissa anser att den brottsbeivrande verksamheten inte har tillräckliga verktyg för att stoppa de grovt kriminella där tystnadskultur råder. Utan vittnesmål kan vissa brott inte klaras upp och dagens lagstiftning innehåller inga incitament för de kriminella att samarbeta med de brottsutredande myndigheterna. En lösning på detta problem kan vara ett kronvittnessystem, när en tilltalad får strafflindring för medverkan vid utredning eller vittnesmål om annans brottsliga gärning.

Den organiserade brottsligheten ökar i Sverige och skördar fler dödsfall varje år. Brotten är svåra att utreda då de ofta sker gränsöverskridande och med tekniska hjälpmedel. Vissa anser att den brottsbeivrande verksamheten inte har tillräckliga verktyg för att stoppa de grovt kriminella där tystnadskultur råder. Utan vittnesmål kan vissa brott inte klaras upp och dagens lagstiftning innehåller inga incitament för de kriminella att samarbeta med de brottsutredande myndigheterna. En lösning på detta problem kan vara ett kronvittnessystem, när en tilltalad får strafflindring för medverkan vid utredning eller vittnesmål om annans brottsliga gärning.

I Danmark har en sådan strafflindringsgrund växt fram genom praxis. Kort efter domen som införde det danska kronvittnessystemet lagstadgades även kronvittnessystemet.

I Sverige har vi nio strafflindringsgrunder som är stadgade i 29 kap. 5 § BrB. Dessa så kallade ”billighetsskäl” hänför sig endast till gärningsmannen som person, till exempel hög ålder eller svår sjukdom vid domstillfället. Efter en dom i högsta domstolen, NJA 2009 s. 599 finns dock en chans för kronvittnen att få strafflindring. Domstolen tolkade det sista billighetsskälet så att strafflindring ska utges till den som vittnar mot annans brottsliga gärning och på grund av detta blir utsatt för hot om allvarliga repressalier.

Flertalet gånger de senaste 20 åren har staten utrett om vi borde införa ett kronvittnessystem men slutsatsen har alltid varit att det är för rättsosäkert. Ett annat argument emot ett införande är att bevisvärdet av den tilltalades vittnesmål är så lågt att systemet blir ineffektivt och oekonomiskt.

Riksdagen har nu beslutat att regeringen ska utreda frågan igen. (Less)

Organized crime is increasing in Sweden and harvests more deaths every year. The crimes are difficult to investigate as they are often of international character and executed with technical aids. Some believe that the police does not have enough tools to stop these criminals in which silence culture prevails. Without testimonies, some crimes cannot be resolved and with the legeslation of today there is no incentives provided for the criminals to cooperate with the investigative authorities. A solution to this problem can be a crown witness system, when an accused receives a reducted sentence for participating in the investigation or testifying of another's criminal act.

Organized crime is increasing in Sweden and harvests more deaths every year. The crimes are difficult to investigate as they are often of international character and executed with technical aids. Some believe that the police does not have enough tools to stop these criminals in which silence culture prevails. Without testimonies, some crimes cannot be resolved and with the legeslation of today there is no incentives provided for the criminals to cooperate with the investigative authorities. A solution to this problem can be a crown witness system, when an accused receives a reducted sentence for participating in the investigation or testifying of another's criminal act.

In Denmark, such a system has emerged through precidents. Shortly after the trial that established a crown witness system the danish legislator stipulated a law to regulate the crown witness system.

In Sweden, we have nine grounds for sentence reduction which are stipulated in Chapter 29 § 5 BrB. These so-called "reasons of fairness" relate only to the accused as a person, for example being of old age or suffering from a severe illness at the time of the trial. However, after a ruling by the swedish Supreme Court, NJA 2009 p. 599, there is a slight possibility for a crown witnesses to get reduction of punishment in the final reason of fairness. The verdict interpreted the reason in a way that if an accused lives under threats of serious retaliation because of his testimony against another's criminal act will be subjected to a reduction of punishment.

Many times over the past 20 years, the state has investigated whether we should introduce a crown witness system or not but the conclusion has always been that it is too insecure. Another argument against an introduction is that the probative value of the defendant's testimony is so low that the system becomes inefficient and uneconomical. The Parliament has now decided that the Government will investigate the issue again. (Less)
