Särskilda ungdomshem är de mest frihetsinskränkande platser barn i Sverige kan placeras vid. Barnen vid särskilda ungdomshem är antingen placerade via socialtjänsten eller avtjänar straffet sluten ungdomsvård. Vid de särskilda ungdomshemmen har Statens institutionsstyrelse rätt att besluta om särskilda befogenheter. Särskilda befogenheter är frihetsinskränkande beslut i form av exempelvis vård i avskildhet eller ytlig kroppsbesiktning. För att stärka rättssäkerheten för barn i statens vård infördes en rad lagändringar 2018. En av dessa ändringar var att barn under 15 år vid särskilda ungdomshem fick rätt till juridiskt biträde vid överklagande av särskilda befogenheter.

Vid de särskilda ungdomshemmen har Statens institutionsstyrelse rätt att besluta om särskilda befogenheter. Särskilda befogenheter är frihetsinskränkande beslut i form av exempelvis vård i avskildhet eller ytlig kroppsbesiktning. För att stärka rättssäkerheten för barn i statens vård infördes en rad lagändringar 2018. En av dessa ändringar var att barn under 15 år vid särskilda ungdomshem fick rätt till juridiskt biträde vid överklagande av särskilda befogenheter.

Undersökningen fokuserar på barnets rätt till, och nödvändigheten av juridiskt biträde i praktiken vid överklagande av beslut om särskilda befogenheter. Barnets rätt till offentligt biträde undersöks i tillämpliga lagar samt Europakonventionen och Barnkonventionen. Undersökningen visar att det borde finnas en rätt till offentligt biträde för barn vid överklagande av beslut om särskilda befogenheter enligt Europakonventionen, samt att det finns en definitiv rätt till juridiskt biträde enligt Barnkonventionen.

I den empiriska rättsfallsundersökningen undersöks nödvändigheten av juridiskt biträde i praktiken genom att studera samband mellan förekomsten av juridiskt biträde och yrkande, grunder och eventuella oroande omständigheter i domarna. Undersökningen visar att tillgång till juridiskt biträde möjliggör att barns vilja kan tas i beaktande vid prövningen genom fullgoda yrkanden och grunder. Tillgången till juridiskt biträde har därmed en påvisbar effekt i praktiken. Den påvisbara effekten ger att offentligt biträde är nödvändigt för barns möjlighet att överklaga beslut om särskilda befogenheter i praktiken. (Less)

Special residential homes for young people are the institutions that violate the integrity of children in Sweden the most. Children that stay at the homes are either taken into compulsory care by the social services, or are serving a sentence of institutional care for young persons. The National Board of Institutional Care can use special authority-decisions at the special residential homes. Special authority-decisions invades on the child’s liberty. Solitary confinement and frisk search are examples of special authority-decisions. Amendments of law were made in 2018 to strengthen the rule of law for children in Sweden’s care. This thesis focuses on the child’s right and the necessity of a legal counsel at appeal of special authority-decisions in practice. The child’s right is studied in applicable laws and the European Convention on Human Rights and the UN Convention on the rights of the child. The study revealed that children should have a right to legal counsel in the European convention, and that they have the right to a legal counsel according to the UN Convention on the Rights of the Child.

The necessity of public council is studied in a case study through an analysis of connections between legal counsel and motions, cause of action and the disturbing circumstances. The case study showed that access to legal counsel makes sure that the children’s claims can be considered in court due to correct motions and cause of action. The study also shows that access to legal counsel minimized disturbing circumstances in the cases. The access to legal counsel thereby has a real effect in practice. This real effect shows that access to legal counsel is necessary for children’s ability to appeal special authority-decisions in practice. (Less)
