Betydelsen och innebörden av konsumenttjänstlagens fackmässighetsbegrepp som återfinns i 4 § KtjL är svårdefinierbar. Lagen som tillämpas på flera olika typer av tjänster saknar en specifik definition på en tjänsts praktiska utförande. Begreppet fackmässighet baseras på hur branschen ser ut, vilka metoder som används och vilka regler som gäller i nuläget.

Detta arbete har haft som syfte att reda ut vad som definierar begreppet fackmässighet och hur samma begrepp förhåller sig till andra bestämmelser i konsumenttjänstlagen med avstamp i Myresjöhusfallet. Begreppet fackmässighet baseras på hur branschen ser ut, vilka metoder som används och vilka regler som gäller i nuläget.

Detta arbete har haft som syfte att reda ut vad som definierar begreppet fackmässighet och hur samma begrepp förhåller sig till andra bestämmelser i konsumenttjänstlagen med avstamp i Myresjöhusfallet. Av 4 § KtjL kan det utläsas att en tjänst måste utföras fackmässigt, men i Myresjöhusfallet bedömdes entreprenören agerat vårdslöst, trots att metoden som använts var fackmässig och etablerad branschpraxis. Begreppet har utretts med hjälp av den rättsdogmatiska metoden och den slutliga analysen har haft inslag av de lege ferenda.

Arbetet har visat att det av både praxis och doktrin framgår att entreprenörer och hantverkare har ett ansvar för vilken metod som används vid utförandet. Det spelar ingen roll om metoden varit välanvänd inom branschen tidigare, det är till viss graf aktörens eget ansvar att metoden inte är bristfällig. Hur långt en sådan undersökning ska gå framgår inte, men att visa på att en bedömning av metoden gjorts kan fria från ansvar. En fackmässigt utförd tjänst definieras av vad en konsument normalt kan begära av en fackman. Kravet innebär således att tjänsten kan utföras till en viss miniminivå och sämre utföranden är att betrakta som fel i tjänst. Vill en konsument säkerställa att tjänsten utförs på ett speciellt sätt bör denna avtala om detta med näringsidkaren. (Less)

The Consumer Services Act´s professional execution, which can be found in § 4 KtjL, has generated a wide array of interpretations. The law is applicable to several different varieties of services and therefor lacks a specific and coherent definition of how a service should be performed. The concept of professionalism is based on the type of business, what methods are used and which rules that currently applies. Despite similarity of industries, the professionalism requirement differs depending on the weather, materials and consumer requirements.

The Consumer Services Act´s professional execution, which can be found in § 4 KtjL, has generated a wide array of interpretations. The law is applicable to several different varieties of services and therefor lacks a specific and coherent definition of how a service should be performed. The concept of professionalism is based on the type of business, what methods are used and which rules that currently applies. Despite similarity of industries, the professionalism requirement differs depending on the weather, materials and consumer requirements.

The purpose of this essay has been to investigate what defines the concept of professionalism and in what way the concepts relates to other provisions of the Consumer Services Act and where the Myresjöhus case will be employed as a case study. In 4 § KtjL states that a service must be performed professionally, but in the Myresjöhus case the contractor was judged to be careless, despite the method used being professional and established industry practice. Using the legal dogmatic method has helped to further define the concept of professionalism and the final analysis involves elements of de lege ferenda.

The result of the study has shown that both precedent and doctrine show that contractors and craftsmen have a responsibility for the method of choice. Whether the method has been widely used in the industry previously has no implications on the responsibility of the contractors if the method is defective. The extent of such an investigation is ambiguous, but to illustrate that countermeasures to ensure a method´s sustainability could free the contractor of legal responsibility. A professionally performed service is defined by what a consumer can request from a contractor. The requirement thus indicates that the service can be performed to a certain minimum level and lesser performance is to be regarded as inaccurate. If a consumer wants to ensure that the service is performed in a special way, prearrangements with the contractor should take place. (Less)
